RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a change order in the amount of $70,000 with Mark Thomas & Company for the Design Contract for Lone Tree Way Improvements from Jeffrey Way to Fairview Avenue, CIP Project No. 336-3127.

PREVIOUS ACTION
On February 27, 2001, the City Council approved the Northwest Quadrant Infrastructure Design Engineering Fee Reimbursement Agreement. 

On May 22, 2001, the City Council approved a Professional Consultant Services Agreement with Cordoba Consulting, Inc. for project management services for the Northwest Quadrant Infrastructure.

On February 12, 2002, the City Council approved a Design, Engineering, and Estimating Contract with PG&E for the Undergrounding of the existing 21 kV Overhead Distribution Power Line along Lone Tree Way from Jeffrey Way to Fairview Avenue.

BACKGROUND
The Northwest Quadrant Infrastructure improvements include the phased construction of major street, sewer, water and storm drain facilities required to serve development of the Northwest Quadrant of the City. The City has been working diligently with the designer, Mark Thomas & Company, to complete the design of an integral part of the Northwest Quadrant infrastructure, which includes the improvements on Lone Tree Way from Jeffrey Way to Fairview Avenue. The City asked Mark Thomas & Company to provide a proposal for a joint trench design and for Lone Tree Way alignment analysis at the railroad crossing. Now, based on this proposal, staff is requesting a Design Change Order to include additional design services not covered under the original design contract. The first item for $52,000 is to hire RGA Utility Consultants to design the Joint Utility Trench, which will eliminate all overhead distribution power from Jeffrey Way to Fairview Avenue. With the help of RGA Utility Consultants, the City can help expedite the design process through PG&E, without having to rely on PG&E to design all the necessary improvements and potentially delay the project. This Change Order will help the City maintain a fast-track schedule to improve Lone Tree Way and underground the existing power lines. The second item for $18,000 is for Mark Thomas & Company to perform a Railroad Undercrossing Feasibility Study. This work includes development of a preliminary undercrossing profile which is compatible with an interim at-grade rail crossing and development of alignment alternatives, investigate the major utility impacts of each undercrossing alignment, right-of-way impacts, and total estimated costs.

FISCAL IMPACT
The funds for this work are through Northwest Quadrant developer contributions and will be adjusted accordingly.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER IN THE AMOUNT OF $70,000 FOR MARK THOMAS & COMPANY FOR THE DESIGN CONTRACT FOR LONE TREE WAY IMPROVEMENTS FROM JEFFREY WAY TO FAIRVIEW AVENUE, CIP PROJECT NO. 336-3127.


WHEREAS, on February 27, 2001, the City Council approved the Northwest Quadrant Infrastructure Design Engineering Fee Reimbursement Agreement; and 

WHEREAS, on May 22, 2001, the City Council approved a Professional Consultant Services Agreement with Cordoba Consulting, Inc. for project management services for the Northwest Quadrant Infrastructure; and 

WHEREAS, on February 12, 2002, the City Council approved a Design, Engineering, and Estimating Contract with PG&E for the Undergrounding of the existing 21 kV Overhead Distribution Power Line from Jeffrey Way to Fairview Avenue; and

WHEREAS, Mark Thomas & Company is requesting a Design Change Order to include additional design services not covered under the original design contract; and

WHEREAS, the Design Change Order will allow RGA Utility Consultants to design the Utility Joint Trench and help expedite the design process through PG&E to underground all the power poles from Jeffrey Way to Fairview Avenue; and

WHEREAS, the Design Change Order will allow Mark Thomas & Company to perform a Railroad Undercrossing Feasibility Study.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a Change Order in the amount of $70,000 with Mark Thomas & Company for the Design Contract for Lone Tree Way Improvements from Jeffrey Way to Fairview Avenue, CIP Project No. 336-3127.
