Approve a Resolution accepting the offers of dedication for parcel E for ingress and egress by emergency vehicles, and all areas marked as “P.S.E.” (Public Service Easements) for public use of the private streets (for public services and utility purposes), as shown on the Final Map, and accepting public improvements for Subdivision No. 7871, “Brentwood Country Club”, Blackhawk-Nunn, located north of Balfour Road and west of Fairview Avenue. Parcel A (Spencer Way), Parcel B (Jubilee Drive), Parcel C (Scarlet Way), Parcel D (Goldspur Way), Parcel F (Jubilee Drive), Parcel G (Jubilee Drive) and Parcel H (Jubilee Drive) are private streets.
On March 3, 1993, the Planning Commission approved Planning Commission Resolution No. 93-11, approving Tentative Subdivision Map No. 7816 with conditions.
On April 9, 1996, the City Council approved Resolution No. 96-56; approving the Final Map of Subdivision No. 7871 with a improvement securities and a Subdivision Improvement Agreement.
The Final Map is located on the northerly side of Balfour Road and west of Fairview Avenue, and was recorded on April 25, 1996, in Book 386 of Maps, at page 23, Contra Costa County Records. The Subdivision contains 69 single-family residential lots. A final inspection of these improvements found them to be completed and in conformance with the approved improvement plans.
Parcels A, B, C, D, F, G and H are private streets. Whereas Parcel E is an easement for ingress and egress by emergency vehicles, and all areas marked as “P.S.E” (Public Service Easement) for public use of the private streets were offered for dedication to the City of Brentwood on the Final Map.
When the Final Map was approved by the City Council, the offers of dedication were rejected. Now that the above improvements have been completed, the City must accept the improvements in order to obtain title to the easements and parcels offered on the Final Map.
After the acceptance of improvements, the City will then incur costs associated with necessary repairs to utilities, the amount of which is unknown at this time. A Lighting and Landscape Maintenance District (LLD 94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL PARCELS AND EASEMENTS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 7871, “BRENTWOOD COUNTRY CLUB”, BLACKHAWK-NUNN, LOCATED NORTH OF BALFOUR ROAD AND WEST OF FAIRVIEW AVENUE
WHEREAS, on March 3, 1993, by Planning Commission Resolution No. 93-11 the Planning Commission approved Tentative Subdivision Map No. 7816, with conditions; and
WHEREAS, on April 9, 1996, the City Council approved Resolution No 96-56 approving the Final Map of Subdivision No. 7871, accepting the improvement security and approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and in conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements including sanitary sewer, storm drainage, and water are hereby accepted, and the offers of dedication for public use of all the parcels and public service easements as offered for dedication on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for Parcel E for ingress and egress by emergency vehicles, and all areas marked as “P.S.E” (Public Service Easement) for public use of the private streets, as shown on the Final Map of Subdivision No. 7871.
