RECOMMENDATION 
Reject the claim presented by Kimberly Lombardi related to a September 25, 2001 event as recommended by the City’s third-party insurance adjuster, Contra Costa County Municipal Risk Management Insurance Authority and the City Attorney.

BACKGROUND
On September 25, 2001, Kimberly Lombardi presented a claim against the City for $100,000.00 alleging she was injured on school grounds at the Edna Hill School located at 140 Birch Street, near the school’s gymnasium. She alleges that her foot landed on uneven pavement and loose gravel in the area which had orange fence netting lying on the ground. She further alleged that the City failed to inspect and repair dangerous conditions on school grounds.

Subject/Title: Accept the Work Performed by Kenny Manta Industrial Services for the Repainting of the Elevated Water Tank, CIP Project No. 562-5626

RECOMMENDATION
Approve a Resolution accepting the work performed by Kenny Manta Industrial Services for the Repainting of the Elevated Water Tank, CIP Project No. 562-5626, located at 4061 Walnut Boulevard, and direct the City Clerk to file a Notice of Completion with the County Recorder. 

PREVIOUS ACTION
On March 29, 2001, the Water and Sewer Sub-Committee reviewed and approved paint color options and the placement of the Brentwood Logo for this project.

On May 22, 2001, the City Council approved and adopted the 2001/2006 Capital Improvement Program for the City. This project is included in the program.

On August 28, 2001, the City Council authorized the City Manager to award a contract to Kenny Manta Industrial Services to repaint the Elevated Water Tank located at 4061 Walnut Boulevard.

BACKGROUND
Kenny Manta Industrial Services completed the repainting of the Elevated Water Tank and met all contractual requirements necessary to receive the remaining retention for this work. This project was complete on time and within budget.
