RECOMMENDATION 
Approve the second reading of Ordinance No. 697 repealing a portion of Brentwood Municipal Code Section 2.24.050 pertaining to the requirement that all department heads must be appointed on an open and promotional basis

PREVIOUS ACTION
City Council approved the first reading of Ordinance 697 on January 22, 2002.

BACKGROUND
In 1969, city staffing was much different than it is today. In many departments, new positions have been added that through training and recruitment permit promotion from within the ranks of the department. It has been found that promotion from within the department is good for staff morale. Through promotional process, it allows current staff to move up in the organization.

By deleting the provision of the requiring department head positions to fill only by an open and promotional basis, this does eliminate the option to do exactly this process. This amendment merely removes the requirement and allows the City Manager the option to promote department heads from existing staff, without needless expense and time for an open recruitment.

ORDINANCE NO. 697


AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD REPEALING A PORTION OF BRENTWOOD MUNCIPAL CODE SECTION 2.24.050 PERTAINING TO APPOINTMENTS AND PROMOTIONS

WHEREAS, the City Council approved Ordinance No.187 in 1969 that included the requirement that every department head position shall be filled on an open and promotional basis;

WHEREAS, the City Council does not believe that it is in the best interest of staffing to require all department positions to be filled on an open and promotional basis and it is better to review each department head position on case-by-case basis;

NOW, THEREFORE BE IT RESOLVED the City Council of the City of Brentwood does ordain as follows:

Section 2.24.050 of the Brentwood Municipal Code is amended to read as follows:

2.24.050 Appointments and Promotions--Qualification procedure described.

Persons shall be selected for appointment to vacant positions on the basis of merit,
fitness, and ability to perform the requirements of the position as determined by 
examinations. Examination content may consist of any combination of qualifying and
competitive tests appropriate to the position to be filled. Recruiting and examination 
procedures shall be determined after consideration of expected availability of 
applicants, requirements of the positions, and the needs of the service. In those cases
where existing personnel form an adequate basis of selection, examinations may be 
limited to a promotional basis only. 

This ordinance shall take effect thirty (30) days after passage and shall within fifteen (15) days after passing, be posted in accordance with section 36933 of the Government Code of the State of California with the names of those City Councilmembers voting for or against it. 

The foregoing ordinance was introduced at a regular meeting of the City Council of the City of Brentwood, held on the 22nd day of January, 2002.
