Subject/Title: Approve a Resolution authorizing the City Manager to approve right of way services provided by Associated Right of Way Services, Inc. in an amount not to exceed $185,500 for the Northwest Quadrant Infrastructure Project, CIP No. 336-3127.

RECOMMENDATION
Approve a Resolution authorizing the City Manager to approve right of way services provided by Associated Right of Way Services, Inc. in an amount not to exceed $185,500 for the Northwest Quadrant Infrastructure Project, CIP No. 336-3127, and authorize the City Manager to execute change orders up to 10% of the authorized amounts.

PREVIOUS ACTION
On November 10, 1998, the City Council approved Resolution No. 98-196 that annexed the northwest area into the City of Brentwood.

On November 28, 2000, the City Council approved Resolution No. 2203 to take various actions. The actions included adding the Northwest Quadrant Infrastructure to the 2000/05 Capital Improvement Program, directing the City Engineer to initiate right of way acquisitions in order to widen Lone Tree Way, directing the City Engineer to initiate discussions with the development community to develop a Capital Improvement Financing Program (CIFP 2001-1) to assist in financing the required engineering and infrastructure to support the anticipated commercial development in this quadrant of the City, directing the City Engineer to hire a consultant to assist the City in developing environmental mitigation measures for this and other City infrastructure and, if possible, develop a mitigation bank to keep environmental mitigation expenditures within the City limits of Brentwood or immediately adjacent, to the maximum extent possible.

On February 27, 2001, the City Council approved Resolution No. 2246 approving the form and content of the Northwest Quadrant Infrastructure Design Engineering Fee Reimbursement Agreement and related actions.

On May 8, 2001, the City Council authorized the City Manager to execute a Consultant Services Agreement for fiscal year 2001/02, to continue utilizing the right of way services of Associated Right of Way Services, Inc.

On May 22, 2001, the City Council by Resolution No. 2299 certified and approved the Negative Declaration and adopted the 2001/2006 Capital Improvement Program (CIP) for the City of Brentwood including street, park, sewer, water and other municipal improvements to be constructed during the next five years.

On May 22, 2001, the City Council authorized the City Engineer to execute a Consultant Services Agreement with Cordoba Consulting, Inc. for project management services not to exceed $115,000 for the Northwest Quadrant Infrastructure, CIP Project No. 336-3127.

On September 25,2001, the City Council approved the Streets Cooperative Agreement between the City of Antioch and the City of Brentwood regarding development of the southeast corner of Lone Tree Way/Heidorn Ranch Road, and authorized the Mayor and City Attorney to sign the document of behalf of the City.

On October 23, 2001, the City Council certified Fairview Avenue/Lone Tree Way realignment Environmental Impact Report (EIR) and approved a resolution adopting the general realignment of Fairview Avenue related to the Northwest Quadrant Infrastructure, CIP Project No. 336-3127.

BACKGROUND
The original scope of work for widening Lone Tree Way covered only the acquisition of four homes located at the corner of Lone Tree Way and Fairview Avenue. The current phase of work includes the widening of Lone Tree Way from Heidorn Ranch Road to Fairview Avenue, which include multiple appraisals and acquisitions from homeowners.

This expanded scope of work and the aggressive schedule for right of way acquisition has necessitated an expenditure over the authorized amounts as per the current purchasing policy. As a “housekeeping” measure and to continue on the aggressive schedule for right of way acquisition, staff is requesting authorization to continue with this work.

FISCAL IMPACT
Funding derives from both the City and development community with the prepayment of fees by the development community including the roadway, sewer and water fees through the CIFP-2001-1. Adequate funds remain in the approved CIP budget to cover the expenditures.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO APPROVE RIGHT OF WAY SERVICES PROVIDED BY ASSOCIATED RIGHT OF WAY SERVICES, INC. IN AN AMOUNT NOT TO EXCEED $185,500 FOR THE NORTHWEST QUADRANT INFRASTRUCTURE PROJECT, CIP NO. 336-3127, AND AUTHORIZE THE CITY MANAGER TO EXECUTE CHANGE ORDERS UP TO 10% OF THE AUTHORIZED AMOUNTS. 

WHEREAS, on May 8, 2001, the City Council authorized the City Manager to execute a Consultant Services Agreement for fiscal year 2001/02, to continue utilizing the right of way services of Associated Right of Way Services, Inc.; and

WHEREAS, on May 22, 2001, the City Council approved Resolution No. 2299 adopting the City’s 2001-2006 Capital Improvement Program that includes the Northwest Quadrant Infrastructure Project.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to approve right of way services provided by Associated Right of Way Services, Inc. in an amount not to exceed $185,500 for the Northwest Quadrant Infrastructure Project, CIP No. 336-3127, and authorize the City Manager to execute change orders up to 10% of the authorized amounts.
