Subject/Title: Acceptance of Park Improvements for Subdivision 8199, KB Home

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for Parcel A – Neighborhood Park, located in Subdivision 8199, “California Orchard Unit 1,” (KB Home) for public use as shown on the Final Map and accepting public improvements for maintenance, accepting the Maintenance Bond and releasing the Performance and Payment Bonds for Neighborhood Park Improvements in Subdivision 8199, “California Orchard Unit 1” by KB Home, located south of Continente Avenue and west of Walnut Boulevard.

PREVIOUS ACTION
On May 11, 1999, the Planning Commission passed Planning Commission Resolution No. 99-120, approving the Tentative Map of Subdivision 8199 with conditions.

On July 25, 2000, the City Council approved Resolution No 2119; approving the Final Map of Subdivision 8199 with improvement securities and subdivision improvement agreement.

On May 22, 2001, the City Council approved Resolution No 2301; accepting the off-site improvements of Subdivision 8199 for maintenance, located along Walnut Boulevard and Continente Avenue.

BACKGROUND
The Final Map is located on the southerly side of Continente Avenue and west of Walnut Boulevard, and was recorded on August 9, 2000, in Book 422 of Maps, at page 21, Contra Costa County records. The subdivision contains 115 single-family residential lots.

Parcel A – Neighborhood Park was offered for dedication in fee on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that Parcel A - Neighborhood Park is improved, final inspection of these improvements found them to be completed in conformance with the approved improvement plans. The City must accept the improvements in order to obtain rights to the parcel offered on the Final Map. The developer of subdivision 8199, KB Home, has already provided a Maintenance Bond (bond No. 24-66-38 for $70,149) to cover the twelve-month warranty period for any material and workmanship for these improvements.

FISCAL IMPACT
After acceptance of the Park, the City will then incur an annual cost of approximately $26,520 associated with necessary ongoing park maintenance through Citywide Park Maintenance District 98-1.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFER OF DEDICATION IN FEE FOR PARCEL “A” - NEIGHBORHOOD PARK FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS, ACCEPTING THE MAINTENANCE BOND, AND RELEASING THE PERFORMANCE AND PAYMENT BONDS FOR NEIGHBORHOOD PARK IN SUBDIVISION 8199, “CALIFORNIA ORCHARD UNIT 1” BY KB HOME, LOCATED SOUTH OF CONTINENTE STREET AND WEST OF WALNUT BOULEVARD


WHEREAS, on May 11, 1999, by Planning Commission Resolution No. 99-120 the Planning Commission approved the Tentative Map of Subdivision 8199, with conditions; and

WHEREAS, on July 25, 2000, the City Council passed Resolution No 2119 approving the Final Map of Subdivision 8199, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, on May 22, 2001, the City Council passed Resolution No 2301 accepting the off-site improvements along Walnut Boulevard and Continente Avenue for maintenance; and

WHEREAS, the required park improvements have been completed in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the Neighborhood Park improvements on Parcel “A” as shown on the Final Map are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Performance and Payment Bonds for the Park will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for Parcel “A” – Neighborhood Park as shown on the Final Map of Subdivision 8199.
