Set January 8, 2002, as the public hearing date to consider the appeal by International Banking Technologies.
On October 16, 2001, the Planning Commission held a public hearing to consider a conditional use permit application to locate a Union Bank branch within the existing Albertson's store at 4461 Balfour Road. The Commission voted 4 - 1 to deny this conditional use permit. The denial resolution was acted on by the Commission on November 6, 2001.
By the attached statement received November 20, 2001, as required by the Zoning Code Section 17.880.003, International Banking Technologies has provided a written statement as to where they believe there was an error or abuse of discretion made by the Planning Commission in the consideration and action on the matter being appealed, and has paid the appropriate appeal fee. Per Zoning Code Sections 17.880.002 and 003 B and E (Appeal Procedure and Set Hearing), the applicant's appeal statement is being forwarded to the City Council. It is recommended that the City Council set January 8, 2001, as the date for the public hearing on the appeal request.
