RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a Change Order with Jones & Stokes for additional environmental studies associated with the Environmental Impact Report for the Sunset Industrial Complex, CIP Project No. 336-3128, and Sunset Park Master Plan and Expansion, CIP Project No. 522-5201 in an amount not to exceed $36,817, and authorizing the City Manager to approve change orders up to 10% of the contract amount.

PREVIOUS ACTION
On February 13, 2001, the City Council approved the Agreement for Contract Services with Jones & Stokes for the preparation and studies associated with the Environmental Impact Report for the Sunset Industrial Park. 

On May 22, 2001, the City Council approved Resolution No. 2299 adopting the 2001/2006 Capital Improvement Program that includes the Sunset Industrial Complex Project.

BACKGROUND
The California Environmental Quality Act (CEQA) requires certain documents be prepared to support potential projects as part of the environmental process. Specific studies are a large part of these requirements. The need to revise the scope of services with Jones & Stokes directly corresponds to the additional biological, noise, air and visual studies needed to complete the Environmental Impact Report (EIR) on this very large and complex project. The City is also in the process of revising the General Plan that will be addressed as part of the EIR document for this project. 

FISCAL IMPACT
Funding for the EIR is available and derives from Facility Fees, the Enterprise fund and Redevelopment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER WITH JONES & STOKES FOR ADDITIONAL ENVIRONMENTAL STUDIES ASSOCIATED WITH THE ENVIRONMENTAL IMPACT REPORT FOR THE SUNSET INDUSTRIAL COMPLEX, CIP PROJECT NO. 336-3128, AND SUNSET PARK MASTER PLAN AND EXPANSION, CIP PROJECT NO. 522-5201 IN AN AMOUNT NOT TO EXCEED $36,817, AND AUTHORIZING THE CITY MANAGER TO APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT


WHEREAS, on February 13, 2001, the City Council approved the Agreement for Contract Services with Jones & Stokes for the preparation and studies associated with the Environmental Impact Report for the Sunset Industrial Park; and

WHEREAS, on May 22, 2001, the City Council approved Resolution No. 2299 adopting the City’s 2001/2006 Capital Improvement Program that includes the Sunset Industrial Complex Project; and

WHEREAS, as part of the environmental process the California Environmental Quality Act (CEQA) requires various studies to support potential projects; and

WHEREAS, as part of the environmental process, additional studies including biological, noise, air and visual are required to complete the Environmental Impact Report (EIR) for the Sunset Industrial Complex project; and

WHEREAS, the City’s revised General Plan will be addressed as part of the EIR document for this project.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a Change Order with Jones & Stokes for the necessary environmental studies associated with the EIR as part of the Sunset Industrial Complex Project and the Sunset Park Master Plan and Expansion Project, in an amount not to exceed $36,817 and further authorizes the City Manager to approve change orders up to 10% of the contract amount.
