RECOMMENDATION
Approve a Resolution accepting the offers of dedication for the parcels P, Q, R, S, T and U, for ingress and egress by emergency vehicles, all areas marked as “P.S.E.” (public service easements) for public use of the private streets, and parcels X (Summerset), EE (Summerset) and FF (Summerset) for future widening of public streets, parcel L for water pumping, and all easements marked as “W.L.E.” as shown on the Final Map, and accepting public improvements for maintenance, accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvements Performance and Payment Bonds for Subdivision 7939, “Brentwood Country Club” by Blackhawk-Nunn, located south of Balfour Road and west of Fairview Avenue extension.

PREVIOUS ACTION
On August 15, 1995, the Planning Commission approved Planning Commission Resolution No. 95-22, approving the Vesting Tentative Map of Subdivision 7939 with conditions.

On May 27, 1997, the City Council approved Resolution No 97-77; approving the Final Map of Subdivision 7939 with improvement securities and subdivision improvement agreement.

On May 25, 1999, the City Council approved Resolution No 99-125, accepting the offers of dedication of Balfour Road and Fairview Avenue right-of-way, accepting the public improvements for maintenance.

BACKGROUND
The Final Map is located on the southerly side of Balfour Road and west of Fairview Avenue extension, and was recorded on July 2, 1997, in Book 393 of Maps, at page 20, Contra Costa County records. The subdivision contains 160 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of these improvements found them to be completed in conformance with the approved improvement plans.

The parcels P, Q, R, S, T and U are private streets for which an easement for ingress and egress by emergency vehicles, all areas marked as “P.S.E” (public service easement) for public use of the private streets, parcels X, EE, and FF for future public street widening, parcel L for water pumping purposes, and all easements marked as “W.L.E.” were offered for dedication to the City of Brentwood on the Final Map.

When the Final Map was approved by the City Council, the offers of dedication were rejected. Now that the above improvements with the traffic signal at Balfour and Fairview have been completed, the City must accept the improvements in order to obtain title to the easements and parcels offered on the Final Map. The developer of Subdivision 7939, Blackhawk-Nunn, has already provided a Maintenance Bond (Bond No. 430401P for $460,606.80) to cover the twelve-month warranty period for these improvements. Parcels Y (Balfour), Z (Fairview) and BB (Fairview) were previously accepted with Resolution No 99-125.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. A Lighting and Landscape Maintenance District (LLD –94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL PARCELS AND EASEMENTS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 7939, “BRENTWOOD COUNTRY CLUB,” BY BLACKHAWK-NUNN, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF FAIRVIEW AVENUE

WHEREAS, on August 15, 1995, by Planning Commission Resolution No. 95-22 the Planning Commission approved the Vesting Tentative Map of Subdivision 7939, with conditions; and

WHEREAS, on May 27, 1997, the City Council approved Resolution No 97-77 approving the Final Map of Subdivision7939, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, on May 25, 1999, the City Council approved Resolution No 99-125 accepting the offers of dedication of Balfour Road and Fairview Avenue right-of-way and accepting the public improvements for maintenance; and

WHEREAS, the required public improvements have been completed in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements including sanitary sewer, storm drainage, water, fiber optic and the traffic signal at Balfour and Fairview are hereby accepted for maintenance, and the offers of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for the parcels P, Q, R, S, T and U for ingress and egress by emergency vehicles, all areas marked as “P.S.E” (Public Service Easement) for public use of the private streets and parcels X (Summerset), EE (Summerset) and FF (Summerset) for future widening of public streets, parcel L for water pumping purposes, and all easements marked as “W.L.E.” (Water Line Easement), as shown on the Final Map of Subdivision 7939.
