Subject/Title: “Streets Cooperative Agreement” between the City of Antioch and the City of Brentwood for development of the southeast corner of Lone Tree Way/Heidorn Ranch Road

RECOMMENDATION
Approve the “Streets Cooperative Agreement” between the City of Antioch and the City of Brentwood regarding development of the southeast corner of Lone Tree Way/Heidorn Ranch Road, and authorize the Mayor and City Attorney to sign the document on behalf of the City.

PREVIOUS ACTION
On November 10, 1998 the City Council approved Resolution No. 98-196 that annexed the northwest quadrant into the City of Brentwood.

On June 7, 2001 Arcadia Development submitted an application to the City of Brentwood Planning Department for Development of the southeast corner of Lone Tree Way and Heidorn Ranch Road (DR 01-30).

Arcadia Development has paid their Northwest Quadrant engineering fee which helps pay for the design engineering of Lone Tree Way and Heidorn Ranch Road.

BACKGROUND
The staffs of the City of Antioch and Brentwood have negotiated driveway and intersection locations on Lone Tree Way and Heidorn Ranch Road adjacent to the Arcadia Development. The entry locations to this development that caused the delay in this agreement were the ones on Heidorn Ranch Road and specifically the one now located at 696 feet south of the centerline of Lone Tree Way. Antioch has an ordinance that requires a minimum dimension of 800 feet between signalized intersections. This particular intersection will be signalized and therefore the original dimension of 400 feet south of Lone Tree Way caused an ordinance compliance problem for Antioch. The street portion or paved portion of both streets are or will be within the Antioch City Limits. That is an existing condition that cannot be changed at this time.

When the Arcadia Development agreed to relocate the intersection in question to 696 feet south of Lone Tree Way, that solved the problem and we quickly received assurances from the Antioch City Engineer/Director of Public Works, City Manager and Mayor that this location was acceptable to them.

FISCAL IMPACT
The costs of signal maintenance discussed in the agreement will be paid by Arcadia Development through the Landscaping and Lighting district covering the development.

The maintenance of the streets will be by Antioch since they are within their jurisdiction.

The maintenance of the median landscaping, parkway landscaping and street lighting costs will be through the developer’s Landscaping and Lighting District.

Policing responsibilities will be by Antioch since the streets are within their jurisdiction.

The only cost to the City of Brentwood will be the cost of maintaining the wet utilities (sewer, water) in the streets since those will be our facilities. Those costs are anticipated to be $56,166.00 per year and will be reimbursed through the Sewer and Water Enterprise accounts.
