RECOMMENDATION
Approve an ordinance amending Chapter 2.44 Arts Commission, Section 2.44.030 A. of the Brentwood Municipal Code to change current membership boundaries. 


PREVIOUS ACTION
The formation of the Arts Commission was approved by Ordinance 647 on September 26, 2000 by City Council. At the August 14, 2001 City Council meeting, the Arts Commission requested the boundaries for membership in the Arts Commission be changed from the Liberty Union High School District to residents of the City of Brentwood. Staff was requested to bring this item back in the form of a revision to the ordinance.

BACKGROUND 
After eight months as a Commission, the members have come to believe that decisions regarding Brentwood art and cultural issues should be made by Brentwood residents. At the August 18, 2001 meeting, City Council directed staff to bring back a revision to Ordinance 647 that would change membership boundaries to match city limits. Approval of the proposed revision would grandfather existing members through the end of their current terms as they met the membership boundaries when they were appointed, but would no longer meet the boundaries as a result of this revision.

ORDINANCE NO. ______

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AMEND CHAPTER 2.44 ARTS COMMISSION, SECTION 2.44.030A. OF THE BRENTWOOD MUNICIPAL CODE TO CHANGE CURRENT MEMBERSHIP BOUNDARIES TO RESIDENTS OF THE CITY OF BRENTWOOD. 

WHEREAS, the City of Brentwood Arts Commission was formed to encourage, stimulate, promote and foster programs for the cultural enrichment of the City; and

WHEREAS, the Arts Commission contributes to the quality of life in Brentwood and develops an awareness in the business community, in local government, and in the general public of the value of the arts in Brentwood;

WHEREAS, the purpose of this ordinance is to bring the Arts Commission boundaries in line with the city limits. 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby ordain as follows:

Section 1.

A. The foregoing recitals and staff report statement are found and determined to be true and correct.

Section 2.

A. Chapter 2.44 Arts Commission, Section 2.44.030A. of the Brentwood Municipal Code is amended to read as follows:

The arts commission shall consist of no more than twenty-five members, who shall be residents of the City of Brentwood.

Section 3.

A. This Ordinance shall be published in accordance with applicable law, by one or more of the following methods:

1. Posting the entire Ordinance in at least three (3) public places in the City of Brentwood, within fifteen (15) days after its passage and adoption; or

2. Publishing the entire Ordinance at least once in the Ledger Dispatch, a newspaper of general circulation published in the County of Contra Costa and circulated in the City of Brentwood, within fifteen (15) days after its passage and adoption; or

3. Publishing a summary of the Ordinance prepared by the City Attorney in the Ledger Dispatch and posting a certified copy of the entire Ordinance in the Office of the City Clerk at least five (5) days prior to passage and adoption, along with the names of those City Council members voting for and against the Ordinance.

BE IT FURTHER RESOLVED that this Ordinance shall go into effect thirty (30) days after the date of its passage and adoption.

THE FOREGOING ORDINANCE was passed and adopted at a regular meeting of the Brentwood City Council on September 25, 2001, by the following vote:
