Subject/Title: Approve the Purchase Agreement with Valle for Brentwood Blvd. Wastewater Improvement Project, CIP 592-5910

RECOMMENDATION
Approve a Resolution approving an agreement for purchase of a fee parcel with Jesus Valle (Guzman) and Carmen Valle, his wife, as joint tenants, as to an undivided ˝ interest and Jesus R. Guzman Valle and Carmen Valle, husband and wife as joint tenants as to an undivided ˝ interest, for a portion of real property identified as APN 018-150-039, generally located on the west side of Brentwood Boulevard between Sunrise Drive and Lone Tree Way, hereby accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the Deed.

PREVIOUS ACTION
On December 12, 2000, the City Council authorized the construction of water and sewer lines to four parcels near 8310 Lone Tree Way with failing septic systems in need of City sewer service.

On May 22, 2001, the City Council by Resolution No. 2299 certified and approved the Negative Declaration and adopted the 2001/2006 Capital Improvement Program (CIP) for the City of Brentwood including street, park, sewer, water and other municipal improvements to be constructed during the next five years.

On August 28, 2001, the City Council directed the City Engineer to proceed with final design of Alternate C to make sewer service available for the portion of Brentwood Boulevard/Lone Tree Way (Brentwood Blvd. Wastewater Improvement Project CIP 592-5910), and return to Council for the award of the construction contract.

BACKGROUND
The purchase of the Valle property is necessary to provide service to residents and businesses with failing septic tanks between Sunrise Drive and Lone Tree Way. This is one part of the City’s overall goals to provide sewer facilities to as many of the City’s residents as possible.

FISCAL IMPACT
Right of Way is in exchange for installation and connection to a new exclusive sewer line for the El Camino Restaurant.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL WITH JESUS VALLE (GUZMAN) AND CARMEN VALLE, HIS WIFE, AS JOINT TENANTS, AS TO AN UNDIVIDED ˝ INTEREST AND JESUS R. GUZMAN VALLE AND CARMEN VALLE, HUSBAND AND WIFE AS JOINT TENANTS AS TO AN UNDIVIDED ˝ INTEREST, FOR A PORTION OF REAL PROPERTY IDENTIFIED AS APN 018-150-039, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, a portion of real property identified as APN 018-150-039 in the City of Brentwood, that is owned by Jesus Valle (Guzman) and Carmen Valle, his wife, as joint tenants, as to an undivided ˝ interest and Jesus R. Guzman Valle and Carmen Valle, husband and wife as joint tenants as to an undivided ˝ interest is needed for the Brentwood Boulevard Wastewater Improvement Project, CIP 592-5910; and

WHEREAS, a Purchase Agreement between the City of Brentwood and the vested property owners has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Purchase Agreement is hereby approved.

BE IT FURTHER RESOLVED that the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the agreement and any related escrow documents including acceptance of the Grant Deed.

BE IT FURTHER RESOLVED that the City of Brentwood hereby accepts the Grant Deed.
