RECOMMENDATION
Approve a Resolution awarding the construction contract for the 2001/2002 Pavement Management Program, CIP Project No. 336-3083 (01/02), to ______________________; authorizing the City Manager to execute the agreement and necessary documents in the amount of $_____________, which includes bid alternates _________; granting the City Manager authority to execute change orders up to 10% of the contract amount; and authorizing an increase to the project's construction budget to $_________.

PREVIOUS ACTION
On May 22, 2001, City Council approved and adopted the 2001/2006 Capital Improvement Program for the City. The Pavement Management Program, CIP Project No. 336-3083 (01/06) is a part of this program.

BACKGROUND
At the bid opening on September 10, 2001, a total of _____ (__) bids were received. The bids were reviewed and the lowest responsive, responsible base bid was received from ________________________ of _________, California in the amount of $__________. Per the bid documents, the award of contract was based on the base bid alone. The __ bids were:

The list of streets included in this year’s program are: Shirley Street, Broderick Drive, Pine Street (from Brentwood Boulevard to Second), Maple Street (from Brentwood Boulevard to Second), Oak Street (from Brentwood Boulevard to Second), Chestnut Street (from Brentwood Boulevard to Second), Diablo Way (from Oak to Chestnut), Police parking area, First Street (from Pine to South of Fir Street) and sections of Midway (from Pine Street to Chestnut Street).

FISCAL IMPACT
Typically the City reserves $400,000 per year for the Pavement Management Program, which includes design and construction. This project is funded through Measure C and the General Fund.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AWARDING THE CONSTRUCTION CONTRACT TO ________________________________ FOR THE 2001/2002 PAVEMENT MANAGEMENT PROGRAM PROJECT, CIP PROJECT NO. 336-3083 (01/02), GRANTING THE CITY MANAGER AUTHORITY TO EXECUTE THE AGREEMENT IN THE AMOUNT OF $___________, WHICH INCLUDES BID ALTERNATES ________, AND CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT; AND AUTHORIZING AN INCREASE OF THE PROJECT'S CONSTRUCTION BUDGET TO $_______.


WHEREAS, on May 22, 2001, City Council approved and adopted the 2001/2006 Capital Improvement Program for the City, of which the Pavement Management Program, CIP Project No. 336-3083 (01/06) is a part; and

WHEREAS, the bid opening for said project was held on September 10, 2001 and ___________________________ was determined to have provided the lowest, responsible base bid of $__________, which was the basis for awarding the contract.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the City shall award the construction contract to ______________________ in the amount of $__________, which includes bid alternates __________, for the 2001/2002 Pavement Management Program, CIP Project No. 336-3083 (01/02).

BE IT FURTHER RESOLVED that the City Manager is granted the authority to execute the agreement and change orders up to 10% of the contract amount.

BE IT FURTHER RESOLVED that the City Council shall authorize an increase of the project's construction budget to $________ by allowing the transfer of funds from the Street Improvement Fund to said project.

AGREEMENT

PAVEMENT MANAGEMENT PROGRAM
CIP NO. 336-3083 (2001-02)



THIS AGREEMENT FOR CONSTRUCTION is made and entered into this _____ day of ______________, by and between the City of Brentwood (herein called City) and ________________________, a California corporation, a partnership or an individual (circle one) located at _________________________, herein called Contractor.



The City and the Contractor agree as follows:


(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to accept, in full payment for constructing the Project in strict accordance with the Contract Documents and performing all other requirements of the Contract Documents, the sum of _________________________________ dollars ($_____________________) to be paid in accordance with the Contract Documents.


(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law applicable to public contracts are a part of this contract to the same extent as though set forth herein and will be complied with by the Contractor.


(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this Agreement are hereby made a part of and incorporated by reference into this Agreement: The Notice Inviting Bids, Invitation to Bid, Information for Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials Payment Bond, Contractor’s Certificate Regarding Worker’s Compensation, Certificate of Insurance and Endorsement (Worker’s Compensation), Certificate of Insurance and Endorsement (General Liability), General Conditions, Special Provisions, Plans and Specifications, CalTrans Standard Plans and Specifications, City of Brentwood Standard Plans and Specifications, Plans, and supplemental agreements, certifications, and endorsements applicable to this work, with all modifications incorporated in said documents prior to receipt of the Contract Proposals. Any work called for in one Contract Document not mentioned in another is to be performed and executed the same as if mentioned in all Contract Documents.




Contractors are required by law to be licensed and regulated by the Contractor’s State License Board which has jurisdiction to investigate complaints against contractors if a complaint is filed within three years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, California 95826.





This Agreement is executed by the City upon approval by the City Council at their regular scheduled meeting of ___________________________, and the Contractor has caused this Agreement to be duly executed.
