Subject/Title: Closure of Certain Streets to Facilitate the Arts Commissionís 2001 Downtown Barbecue Fundraiser.

RECOMMENDATION Adoption of Resolution authorizing the temporary closure of certain streets and temporarily establishing no parking restrictions and tow away zones in order to facilitate the Brentwood Arts Commission 2001 Downtown Barbecue Fundraiser to be held September 22, 2001. 

PREVIOUS ACTION Historically, the City has authorized the Brentwood Arts and Design Committee to hold a fundraiser on First Street between Oak Street and the driveway to East Diablo Fire Station #54.

BACKGROUND The Brentwood Arts Commission is requesting a street closure on September 22, 2001 between 2:00 p.m. and 11:30 p.m. in order to facilitate their fundraiser. The Arts Commission did not have this fundraiser in calendar year 2000. 

Fiscal impact on the City is estimated to be $796.75. In the event that the City Council elects to fund all or part of the total cost, those funds can be charged to the Police Departmentís Special Events account as approved in the 01/02 fiscal year budget.

RESOLUTION NO. 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE TEMPORARY CLOSURE OF CERTAIN STREETS AND TEMPORARILY ESTABLISHING NO PARKING RESTRICTIONS AND TOW AWAY ZONES IN ORDER TO FACILITATE THE BRENTWOOD ARTS COMMISSION FUNDRAISER TO BE HELD ON SEPTEMBER 22, 2001.


WHEREAS, the Brentwood Arts Commission will be holding their fundraiser on September 22, 2001 between the hours of 2:00 p.m. and 11:30 p.m.; and 

WHEREAS, to accommodate the fundraiser, the Brentwood Arts Commission has requested the temporary closure of the following street as follows:

* First Street from the north curb line of Oak Street to the driveway of East Diablo Fire Station #54 between the hours of 2:00 p.m. and 11:30 p.m. 

WHEREAS, pursuant to Vehicle Code Section 21101(e), the City may temporarily close portions of streets for parades and local special events such as the Brentwood Arts Commission fundraiser when the closing is necessary for the safety and protection of persons who are to use those portions of the street during the temporary closure; pursuant to Vehicle Code 22507, the City may prohibit parking on portions of streets during all or certain hours of the day; pursuant to Vehicle Code Section 22651(b), (m), and (n), the City peace officers may remove by towing any vehicle from those portions of the street where parking is prohibited. 

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood that the Police Department is ordered to close the above mentioned street, prohibit parking and establish a tow away zone between the hours of 2:00 p.m. and 11:30 p.m. for the fundraiser on September 22, 2001
