Approve a Resolution authorizing the City Manager to award a contract to Kenny Manta Industrial Service for the Re-Painting of the Elevated Tank located on Walnut Boulevard north of Dainty Avenue, Steel Reservoir (elevated) CIP Project #562-5626, in the amount of $135,200, and authorizing the City Manager to execute change orders not to exceed 10 percent of the contract amount, thereby amending the CIP project sheet to reflect the approved funding for this project.
On March 29, 2001, the Water and Sewer Sub-Committee reviewed and approved paint color options and the placement of the Brentwood Logo for this project.
On May 22, 2001 City Council approved and adopted the 2001/2006 Capital Improvement Program for the City. This project is included in the program.
This project was put out to bid on July 2, 2001 and a mandatory pre-bid meeting was held July 30, 2001 to ensure that adequate interpretation of the project’s work would be obtained by the prospective bidders. The bids were opened on August 13, 2001 and Kenny Manta Industrial Services submitted the low bid.
The re-coating project will enhance the aesthetic quality of a highly visible landmark, and also contain chipping paint by cleaning and sealing the structure. The project will be done while maintaining the City’s relationship with the wireless communication companies to ensure rental of space on the structure.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO AWARD A CONTRACT TO KENNY MANTA INDUSTRIAL SERVICE FOR THE RE-PAINTING OF THE ELEVATED TANK, STEEL RESERVOIR (ELEVATED) CIP PROJECT 562-5626, IN THE AMOUNT OF 135,200, AND AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDERS NOT TO EXCEED 10 PERCENT OF THE CONTRACT AMOUNT, THEREBY AMENDING THE CIP PROJECT SHEET TO REFLECT THE APPROVED FUNDING FOR THIS PROJECT.
WHEREAS, on March 29, 2001 the Water and Sewer Sub-Committee reviewed and approved paint color options and the placement of the Brentwood Logo for this project; and
WHEREAS, on May 22, 2001, City Council approved and adopted the 2001/2006 Capital Improvement Program for the City which includes this project as a part of the program; and
WHEREAS, on July 2, 2001 this project went out to bid as part of the City’s formal bidding process; and
WHEREAS, on August 13, 2001, a bid in the amount of $135,200 was submitted by Kenny Manta Industrial Service.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the authorization is given to the City Manager of the City of Brentwood to award a contract to Kenny Manta Industrial Service in the amount of $135,200 for this project.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute change orders for contingencies in the amount not to exceed 10 percent of the contract.
BE IT FURTHER RESOLVED that the CIP project sheet reflects the approved funding for this project.

PROJECT NO. 562-5626
THIS AGREEMENT FOR CONSTRUCTION is made and entered into this 28th day of August 2001, by and between the City of Brentwood (herein called City) and Kenny Manta Industrial Service a California corporation, a partnership or an individual (circle one) located at 5199 Fulton Drive, Suite D, Suisun, City, CA 94585, herein called Contractor.
The City and the Contractor agree as follows:
(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to accept, in full payment for constructing the Project in strict accordance with the Contract Documents and performing all other requirements of the Contract Documents, the sum of One Hundred Thirty Five Thousand Two Hundred Dollars ($135,200.00) to be paid in accordance with the Contract Documents.
(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law applicable to public contracts are a part of this contract to the same extent as though set forth herein and will be complied with by the Contractor.
(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this Agreement are hereby made a part of and incorporated by reference into this Agreement: The Notice Inviting Bids, Invitation to Bid, Information for Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials Payment Bond, Contractor’s Certificate Regarding Worker’s Compensation, Certificate of Insurance and Endorsement (Worker’s Compensation), Certificate of Insurance and Endorsement (General Liability), General Conditions, Special Provisions, Plans and Specifications, CalTrans Standard Plans and Specifications, City of Brentwood Standard Plans and Specifications, Plans, and supplemental agreements, certifications, and endorsements applicable to this work, with all modifications incorporated in said documents prior to receipt of the Contract Proposals. Any work called for in one Contract Document not mentioned in another is to be performed and executed the same as if mentioned in all Contract Documents.
Contractors are required by law to be licensed and regulated by the Contractor’s State License Board which has jurisdiction to investigate complaints against contractors if a complaint is filed within three years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, California 95826.
This Agreement is executed by the City upon approval by the City Council at their regular scheduled meeting of August 28, 2001, and the Contractor has caused this Agreement to be duly executed.
