RECOMMENDATION
Approve a Resolution authorizing the City Manager to award a contract to Granite Construction Company in the amount of $6,029,985 for the construction of Sand Creek Road Central Phase 1, CIP Project #336-3061, from just west of Fairview Avenue to just west of the Union Pacific railroad tracks, authorizing the City Manager to execute change orders not to exceed 10 percent of the contract amount, and amending the CIP project sheet to reflect the approved funding for this project.

PREVIOUS ACTION
On October 12, 1999, the City Council authorized the City Engineer to sign a professional services contract for design engineering with Carlson, Barbee & Gibson.

On May 22, 2001 City Council approved and adopted the 2001/2006 Capital Improvement Program for the City. This project is included in the program.

BACKGROUND
This project was put out to bid on May 21, 2001. The bids were opened on August 17, 2001 and Granite Construction Company submitted the low bid. 

The engineer’s estimate for this project was $6,663,927. The project construction schedule has been pushed out for 90 days next spring to allow for the time required to complete the work in Sand Creek. The delays in receiving the permits to work in the creek from US Fish and Wildlife Services and the US Army Corps of Engineers has made it impossible to complete the creek-related work this fall. Staff therefore extended the length of the contract to sufficiently allow for this work.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHOIZING THE CITY MANAGER TO AWARD A CONTRACT TO GRANITE CONSTRUCTION COMPANY FOR THE SAND CREEK ROAD CENTRAL PHASE 1 PROJECT #336-3061, IN THE AMOUNT OF $6,029,985.00 AND AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDERS NOT TO EXCEED 10 PERCENT OF THE CONTRACT AMOUNT.


WHEREAS, on October 12, 1999, the City Council authorized the City Engineer to sign a professional services contract for design engineering with Carlson Barbee & Gibson; and

WHEREAS, on May 22, 2001, City Council approved and adopted the 2001/2006 Capital Improvement Program for the City which includes this project as a part of the program, and

WHEREAS, on May 21, 2001 this project went out to bid as part of the City’s formal bidding process; and

WHEREAS, on August 17, 2001, a bid in the amount of $6,029,985.00 was submitted by Granite Construction Company.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the authorization is given to the City Manager of the City of Brentwood to award a contract to Granite Construction Company in the amount of $6,029,985.00 for this project.

BE IT FURTHER RESOLVED that the City Manager is authorized to execute change orders for contingencies in the amount not to exceed 10 percent of the contract.

AGREEMENT

SAND CREEK ROAD CENTRAL PHASE 1
PROJECT NO. 336-3061



THIS AGREEMENT FOR CONSTRUCTION is made and entered into this 28th day of August 2001, by and between the City of Brentwood (herein called City) and ____________________________ a California corporation, a partnership or an individual (circle one) located at _________________________________, herein called Contractor.



The City and the Contractor agree as follows:


(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to accept, in full payment for constructing the Project in strict accordance with the Contract Documents and performing all other requirements of the Contract Documents, the sum of six million, twenty-nine thousand, nine hundred and eighty-five dollars ($6,029,985.00) to be paid in accordance with the Contract Documents.


(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law applicable to public contracts are a part of this contract to the same extent as though set forth herein and will be complied with by the Contractor.


(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this Agreement are hereby made a part of and incorporated by reference into this Agreement: The Notice Inviting Bids, Invitation to Bid, Information for Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials Payment Bond, Contractor’s Certificate Regarding Worker’s Compensation, Certificate of Insurance and Endorsement (Worker’s Compensation), Certificate of Insurance and Endorsement (General Liability), General Conditions, Special Provisions, Plans and Specifications, CalTrans Standard Plans and Specifications, City of Brentwood Standard Plans and Specifications, Plans, and supplemental agreements, certifications, and endorsements applicable to this work, with all modifications incorporated in said documents prior to receipt of the Contract Proposals. Any work called for in one Contract Document not mentioned in another is to be performed and executed the same as if mentioned in all Contract Documents.


Contractors are required by law to be licensed and regulated by the Contractor’s State License Board which has jurisdiction to investigate complaints against contractors if a complaint is filed within three years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, California 95826.

This Agreement is executed by the City upon approval by the City Council at their regular scheduled meeting of August 28, 2001, and the Contractor has caused this Agreement to be duly executed.
