Walnut Boulevard and Oak Street

RECOMMENDATION
Authorize, by resolution, the City Manager or his designee to execute a Grant Deed transferring ownership of the property located on the southeast corner of Walnut Boulevard and Oak Street (APN 013-232-006) (see attached map) to the Brentwood Redevelopment Agency. 

PREVIOUS ACTION
On March 8, 1988, by Resolution No. 88-1, the Brentwood Redevelopment Agency authorized the purchase the property located on the southeast corner of Walnut Boulevard and Oak Street from Southern Pacific Transportation, using Redevelopment Agency funds. 

COMMENTS
Redevelopment staff anticipates soliciting proposals from interested parties to be considered for selection as Master Developer to develop the southeast corner of Walnut Boulevard and Oak Street in conformance with the Brentwood (Downtown) Redevelopment Plan. Upon selection of a Master Developer, the Agency would enter into an agreement which sets out the specific obligations of the developer and the Agency, including the terms of disposition of the property. 

Although the property was purchased on March 22, 1988, with Redevelopment Agency funds, the deed transferring ownership was inadvertently made to the City of Brentwood. As a housekeeping issue, and to further staff’s efforts to package this property as a redevelopment project, it is necessary for the City Council to authorize conveyance of this property to the Brentwood Redevelopment Agency. 

On May 9, 2000, by Resolution No. RA-18, the Redevelopment Agency authorized the Executive Director and Agency Attorney to accept deeds or grants conveying any interest in real property for the Agency. Therefore, no corresponding action by the Brentwood Redevelopment Agency is necessary for this transaction.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE A GRANT DEED TRANSFERRING OWNERSHIP OF THE SOUTHEAST CORNER OF WALNUT BOULEVARD AND OAK STREET (APN 013-232-006) TO THE BRENTWOOD REDEVELOPMENT AGENCY



WHEREAS, on March 8, 1988, by Resolution No. 88-1, the Brentwood Redevelopment Agency authorized the purchase of real property located at the southeast corner of Walnut Boulevard and Oak Street, City of Brentwood, from Southern Pacific Transportation; and

WHEREAS, the property located at the southeast corner of Walnut Boulevard and Oak Street, City of Brentwood, was acquired with Redevelopment Agency funds; and

WHEREAS, ownership was inadvertently transferred to the City of Brentwood; and

WHEREAS, a new Grant Deed must be executed and recorded to convey ownership to the Brentwood Redevelopment Agency.

NOW, THEREFORE BE IT RESOLVED that the City Manager or his designee are authorized to execute the Grant Deed and any related escrow documents to correct and convey the ownership of the southeast corner of Walnut Boulevard and Oak Street, to the Brentwood Redevelopment Agency.
