Subject/Title: Approve the Purchase Agreement with the Sciortinos for Brentwood Boulevard Widening (ISTEA), CIP Project No. 336-3054

RECOMMENDATION
Approve a Resolution approving an agreement for purchase of a fee parcel, with Theodore D. Sciortino and Mary Jane Sciortino, his wife, as joint tenants as to an undivided 1/3 interest; and Frank Sciortino, subject to item #11 as to an undivided 1/3 interest and Constance T. Sciortino, Trustee, The Constance T. Sciortino Trust dated 17 July 1984, as to an undivided 1/3 interest, for a portion of real property identified as APN 016-230-006, 016-230-007, 016-170-002 and 016-170-006, generally located east of Brentwood Boulevard between Applewood Common and Nancy Street, hereby accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the Deed.

PREVIOUS ACTION
On July 25, 2000, City Council authorized the City Manager to enter into a professional services agreement with Harris and Associates for the design of Brentwood Boulevard Widening (ISTEA) CIP Project No. 336-3054.

On May 8, 2001, the City Council approved Resolution 2284 authorizing the City Manager to execute Program Supplement Agreement No. 003-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of cost for Right of Way, Construction and Construction Engineering for the Brentwood Boulevard Widening Project (ISTEA), CIP Project No. 336-3054.

BACKGROUND
The purchase of the Sciortino property is necessary to continue the widening of Brentwood Boulevard, which will improve traffic safety and circulation. Included in the project is the installation of curbs, gutters, medians, sidewalks, bike lanes and streetlights. This project will also modify the traffic signal at Brentwood Boulevard/Sand Creek Road and install signal interconnect as needed along the entire length.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL, WITH THEODORE D. SCIORTINO AND MARY JANE SCIORTINO, HIS WIFE, AS JOINT TENANTS AS TO AN UNDIVIDED 1/3 INTEREST; AND FRANK SCIORTINO, SUBJECT TO ITEM #11 AS TO AN UNDIVIDED 1/3 INTEREST AND CONSTANCE T. SCIORTINO, TRUSTEE, THE CONSTANCE T. SCIORTINO TRUST DATED 17 JULY 1984, AS TO AN UNDIVIDED 1/3 INTEREST, FOR A PORTION OF REAL PROPERTY IDENTIFIED AS APN 016-230-006, 016-230-007, 016-170-002 AND 016-170-006, GENERALLY LOCATED EAST OF BRENTWOOD BOULEVARD BETWEEN APPLEWOOD COMMON AND NANCY STREET, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, a portion of the real property identified as APN 016-230-006, 016-230-007, 016-170-002 and 016-170-006 in the City of Brentwood, that is owned by Theodore D. Sciortino and Mary Jane Sciortino, his wife, as joint tenants as to an undivided 1/3 interest; and Frank Sciortino, subject to item #11 as to an undivided 1/3 interest and Constance T. Sciortino, Trustee, The Constance T. Sciortino Trust dated 17 July 1984, as to an undivided 1/3 interest, is needed for the Brentwood Boulevard Widening (ISTEA) Project, CIP 336-3054; and

WHEREAS, a Purchase Agreement between the City of Brentwood and the vested property owners has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Purchase Agreement is hereby approved.

BE IT FURTHER RESOLVED that the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the Agreement and any related escrow documents including acceptance of the Grant Deed.

BE IT FURTHER RESOLVED that the City of Brentwood hereby accepts the Grant Deed.
