Subject/Title: Acceptance of Improvements for SPA L-CIFP 98-1 in Assessment District
98-2 SPAL Builders

RECOMMENDATION
Approve a Resolution accepting the public improvements in SPA L (CIFP 98-1) for maintenance, accepting the Maintenance Bond for SPA L, by SPA L Builders, located south of Minnesota Avenue, east of Fairview Avenue and west of the Union Pacific Railroad tracks.

PREVIOUS ACTION
On February 10, 1998, the City Council passed Resolution No. 98-26 appointing an Underwriter, Bond counsel, and Engineer of Work in and for Assessment District No. 98-2 and CIFP 98-01.

On February 10, 1998, the City Council passed Resolution No 98-27; approving Deposit, Reimbursement and Acquisition Agreements in and for Assessment District No. 98-2 and CIFP 98-01.

On April 28, 1998, the City Council passed Resolution No 98-63 approving Capital Improvement Financing Plan 98-1 and acknowledging certain findings of the City Manager in accordance with Title 17.805 of the Brentwood Municipal Code.

BACKGROUND
SPA L is located south of Minnesota Avenue, east of Fairview Avenue, and west of Union Pacific Railroad. The public improvements completed in SPA L (CIFP 98-1) are as follows:

A final inspection of the public improvements found them to be completed in conformance with the approved improvement plans.

The developer, SPA L Builders, also has provided a Maintenance Bond (bond No. 6110239 for $594,629.80) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE ACCEPTING THE MAINTENANCE BOND FOR SPA L - CIFP 98-01, BY SPA L BUILDERS, LOCATED SOUTH OF MINNESOTA AVENUE AND EAST OF FAIRVIEW AVENUE AND WEST OF UNION PACIFIC RAILROAD



WHEREAS, on February 10, 1998, the City Council passed Resolution No. 98-26 appointing an Underwriter, Bond Counsel, and Engineer of Work in and for Assessment District No. 98-2 and CIFP 98-01; and

WHEREAS, on February 10, 1998, the City Council passed Resolution No 98-27; approving Deposit, Reimbursement and Acquisition Agreements in and for Assessment District No. 98-2 and CIFP 98-01, and

WHEREAS, on April 28, 1998, the City Council passed Resolution No 98-63 approving Capital Improvement Financing Plan 98-1 and acknowledging certain findings of the City Manager in accordance with Title 17.805 of the Brentwood Municipal Code; and

WHEREAS, the required public improvements have been completed in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.
