RECOMMENDATION 
Reject the claim presented by Lorna Mesina as recommended by the Cityís third-party insurance adjuster, Contra Costa County Municipal Risk Management Insurance Authority and the City Attorney.

BACKGROUND
On April 19, 2001 Lorna Mesina filed a claim in the amount of $627 for damage to the running boards on the claimantís 1991 Dodge Grand Caravan. A water plate that did not set flush with the concrete caused the alleged incident that occurred January 3, 2001 at Anderson Lane and Lone Tree Way. Public Works staff reported that there were no other claims or complaints regarding this subject plate. Since there is nothing reasonable the city could have done to prevent the loss from occurring, the city would have not liability based on lack of notice.
