Subject/Title: Acceptance of Park Improvements of Lot #14 of 8323 Final Map (Hancock Park in Brentwood Lakes)

Approval of a Resolution accepting the offers of dedication in fee of Lot #14 (Hancock Park) of 8323 Final Map, (Lee Hancock Construction, Inc.), for park purposes shown thereon, accepting public improvements with landscaping for maintenance, accepting the Maintenance Bond and releasing the Performance and Payment Bonds for Lot #14 located north of Balfour Road and west of East Country Club Road.
On May 9,2000, by Resolution No. 2070, City Council approved the Final Map of Subdivision 8323, with improvement securities and subdivision improvement agreement.
The Final Map is located north of Balfour Road and west of Fairview Avenue and was recorded on June 26, 2000, in Book 421 of Maps, at page 1, Contra Costa County records. The subdivision contains 14 lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of the improvements for Lot #14 found them to be completed in conformance with the approved improvement plans.
The Lot #14 was offered for dedication in fee on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to the acceptance of improvements. Now that all improvements are completed, the City must accept the improvements in order to obtain rights to the Lot #14 offered on the final map. The developer, Lee Hancock Construction, Inc., has already provided a Maintenance Bond (Cash for $37,500.00) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. City Wide Park Maintenance District #98-1 has been formed for the parks and will be responsible for the park lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE OF LOT #14 (HANCOCK PARK0 OF SUBDIVISION 8323 FINAL MAP, BRENTWOOD LAKES, LEE HANCOCK CONSTRUCTION, INC. FOR PARK PURPOSES SHOWN THEREON, ACCEPTING LOT #14, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE MAINTENANCE BOND AND RELEASING THE PERFORMANCE AND PAYMENT BONDS FOR LOT #14, LOCATED NORTH OF BALFOUR ROAD AND WEST OF EAST COUNTRY CLUB DRIVE
WHEREAS, on May 9, 2000 the City Council passed Resolution No. 2070 approving the Final Map of Subdivision 8323, Brentwood Lakes, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements for Lot #14 (Hancock Park), have been completed in conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements for Lot #14 (Hancock Park) are hereby accepted for maintenance.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
BE IT FURTHER RESOLVED that the Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.
BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for the Lot #14 (Hancock Park) as shown on the Final Map for subdivision 8323.
