Approve a Resolution consenting to the payment of the costs of certain publicly owned facilities by the Redevelopment Agency of the City of Brentwood and making findings therewith. Authorize the City Manager to complete the First Street Parking Lot construction including landscaping, CIP Project No. 336-3118, for a total construction cost not to exceed $154,000.
Authorize a loan in the amount of $154,000 from the City’s Water Facility Fee Fund to the Redevelopment Agency for the Completion of the First Street Parking Lot, CIP Project No. 336-3118, including associated landscaping costs.
On February 8, 2000 a resolution was passed to purchase the property at 604 First Street to Construct a Parking Lot.
On November 14, 2000 the City Council awarded a contract to Granite Construction in the amount of $113,275 to construct the parking facility. This project inadvertently was not brought before the Redevelopment Agency. To correct this oversight, staff is also bringing this project before the Redevelopment Agency.
This project is located within the Downtown Redevelopment Project Area. The City adopted Ordinance 333 on July 13, 1982, the Downtown Brentwood Redevelopment Project Area. The Redevelopment Agency Board was in charge of carrying out the program and over the years, have done a number of beautification and infrastructure improvements. These efforts have proven to be very successful investments for the agency as renewed vibrancy of downtown and the appreciation in downtown property values have been significant.
The resolution authorizes a loan from the City’s Water Facility Fee fund in the amount of $154,000 to the Brentwood Redevelopment Agency. In order to continue to generate Redevelopment funds, the Redevelopment fund must continue to incur debt. This action helps create that debt.
The original project, designed by City staff, included grading, paving, drainage, and striping. During construction extra costs were incurred due to a chemical substance uncovered during the grading process. Additional funds are needed to account for these costs including project management during construction and additional land acquisition costs associated with the purchase of the property. Staff recently obtained bids to landscape the parking facility in the amount of $10,900. The total cost to complete the project is estimated not to exceed $154,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD CONSENTING TO THE PAYMENT OF THE COSTS OF CERTAIN PUBLICLY OWNED FACILITIES BY THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD AND MAKING FINDINGS THEREWITH. AUTHORIZE THE CITY MANAGER TO COMPLETE THE FIRST STREET PARKING LOT CONSTRUCTION INCLUDING LANDSCAPING, CIP PROJECT NO. 336-3118, FOR A TOTAL CONSTRUCTION COST NOT TO EXCEED $154,000.
AUTHORIZE A LOAN IN THE AMOUNT OF $154,000 FROM THE CITY’S WATER FACILITY FEE FUND TO THE REDEVELOPMENT AGENCY FOR THE COMPLETION OF THE FIRST STREET PARKING LOT, CIP PROJECT NO. 336-3118, INCLUDING ASSOCIATED LANDSCAPING COSTS.
WHEREAS, the Redevelopment Plan for the Brentwood Redevelopment Project (the “Downtown Project”) was adopted by the City Council of the City of Brentwood (“City Council”) by Ordinance No. 333 on July 13, 1982, as amended, and is being carried out by the Redevelopment Agency of the City of Brentwood “(Agency”); and
WHEREAS, pursuant to Section 33445 of the Health and Safety Code, the Agency is authorized, with the consent of the City Council and upon making certain findings, to pay all or part of the value of the land for and the cost of installation and construction of any building, facility, structure or other improvement which is publicly owned, either within or without the Project; and
WHEREAS, the City is constructing a City-owned public parking lot within the Project located at 604 First Street (the “Public Parking Lot”), the cost of which will be paid by the Agency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood as follows:
1. The City Council hereby finds and determines as follows with respect to the payment of the cost of constructing the Public Parking Lot by the Agency:
a. The Public Parking Lot will be of benefit to the Project.
b. No other reasonable means of financing the Public Parking Lot are available to the community.
c. The payment of the cost of constructing the Public Parking Lot will assist in the elimination of one or more blighting conditions within the Project and is consistent with the Agency’s implementation plan adopted pursuant to Health & Safety Code Section 33490.
2. The sum of $154,000 is hereby appropriated and loaned to the Brentwood Redevelopment Agency Capital Project Fund, from the Water Facility Fee Fund.
3. Such appropriation is hereby authorized to be paid to the Agency as a loan to be repaid from any legally available funds of the Agency with interest from the date funds are actually transferred to the Redevelopment Agency by the city, to the date of repayment by the Agency (calculated on a 360 day year basis) at the rate of six percent (6%). The debt created hereby shall be subordinated to any other indebtedness of the Agency, presently existing or hereafter incurred, for the purpose of fulfilling the redevelopment activities of the Agency.
4. This loan to the Brentwood Redevelopment Agency shall be repaid from Agency Tax Increment Revenues, no later than June 30, 2002.
5. The City Council hereby consents to the payment of the cost of constructing the Public Parking Lot by the Agency. Costs of construction not to exceed $154,000.
