RECOMMENDATION
Approve a Resolution of Public Interest and Necessity requiring the dedication described in the Deferred Public Improvement Agreement with Ben and Beverly Peterson recorded April 9, 1971 in Book 6356 at Page 342, affecting 5 property owners on Griffith Lane, relating to the Brentwood Bikeway Project, CIP Project No. 336-3071.

PREVIOUS ACTION
On November 10, 1970, by Resolution 151 - X the City Council authorized and directed the Mayor to enter into an agreement with Ben and Beverly Peterson for Deferred Public Improvements in connection with Minor Subdivision MS 71-3.

On February 11, 1997, by Resolution No. 97-24 the City Council approved an Agreement with the State of California Department of Transportation to provide funds for the City of Brentwood Bikeway Project, designating the City Manager as the City’s authorized representative to execute the agreement and transmit copies of both to the California Department of Transportation.

On May 23, 2000, by Resolution No. 2076, the City Council certified and approved the Negative Declaration and adopted the 2000/2005 Capital Improvement Program (CIP), which included the Brentwood Bikeway Project, CIP Project No. 336-3071.

BACKGROUND
The Brentwood Bikeway Project includes widening Griffith Lane on the west side from 500 feet north of McClarren Road to Dainty Avenue and on the east side from Dainty Avenue to Central Boulevard. In order for us to complete this project, we need to exercise our rights under the Deferred Improvement Agreement in connection with Minor Subdivision MS 71-3. One of the conditions to trigger the offers of dedication for a 42 foot strip and a 25 foot strip is the City Council's approval of a Resolution of Public Interest and Necessity.

Funding for this project is through a State Grant.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A RESOLUTION OF PUBLIC INTEREST AND NECESSITY REQUIRING THE DEDICATION DESCRIBED IN THE DEFERRED PUBLIC IMPROVEMENT AGREEMENT RECORDED APRIL 9, 1971 IN BOOK 6356 AT PAGE 342.



WHEREAS, on November 10, 1970, by Resolution 151 - X the City Council authorized and directed the Mayor to enter into an agreement with Ben and Beverly Peterson for Deferred Public Improvements in connection with Minor Subdivision MS 71-3; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Resolution of Public Interest and Necessity is approved.
