Subject/Title: Acceptance of Improvements for Subdivision 6811 “Solana,” Mission Peak Homes

Approve a Resolution accepting the offers of dedication and, accepting the public improvements for maintenance, accepting the Subdivision Maintenance Bond, and releasing the Subdivision Performance and Payment Bonds for Subdivision 6811, “Solana” by Mission Peak Homes, located north of Central Boulevard and east of Fairview Avenue.
On April 19, 1988, the Planning Commission passed Planning Commission Resolution No. 88-09, approving the Tentative Map of Subdivision 6811 with conditions.
On January 27, 1998, the City Council passed Resolution No 98-18; approving the Final Map and accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.
The Final Map is located north of Central Boulevard and east of Fairview Avenue, and was recorded on May 11, 1998, in Book 399 of Maps, at page 46, Contra Costa County records. The subdivision contains 82 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of the street improvements found them to be completed in conformance with the approved improvement plans.
Parcels “A,” “E,” and “F” were offered for dedication to the City of Brentwood on the Final Map, as well as the following streets: Summerwood Drive, Sunshine Court, Fall Drive, Sunlight Drive, Solana Drive, Spring Street, Autumn Drive, Cherrytree Court, Cherrytree Way and Fairview Avenue. Also parcel “L.M.E.” (Landscape Maintenance Easement) and areas marked “P.U.E” (Public Utility Easement) were offered for dedication to the City of Brentwood on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were subject to the acceptance of improvements. Now that the above improvements have been completed, the City must accept the improvements in order to obtain title to the easements and parcels offered on the Final Map. The developer of Subdivision 6811, Mission Peak Homes, has already provided a Maintenance Bond (bond No. 1676111 for $226,860.00) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. A Lighting and Landscape Maintenance District (LLD 98-3) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL PARCELS AND EASEMENTS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE ACCEPTING THE SUBDIVISION MAINTENANCE BOND, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 6811, “SOLANA,” BY MISSION PEAK HOMES, LOCATED NORTH OF CENTRAL BOULEVARD AND EAST OF FAIRVIEW AVENUE
WHEREAS, on April 19,1988, by Planning Commission Resolution No. 88-09 the Planning Commission approved the Tentative Map of Subdivision 6811, with conditions; and
WHEREAS, on January 27,1998, the City Council passed Resolution No 98-18 approving the Final Map of Subdivision 6811, Mission Peak Homes, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements, have been completed in conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.
BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for Parcels “A,” “E,” and “F” for public use, the following streets: Summerwood Drive, Sunshine Court, Fall Drive, Sunlight Drive, Solana Drive, Spring Street, Autumn Drive, Cherrytree Court, Cherrytree Way and Fairview Avenue; all areas marked as “L.M.E.” (Landscape Maintenance Easement) for public use, and all areas marked as “P.U.E.” (Public Utility Easement) as shown on the Final Map of Subdivision 6811.
