Subject/Title: Subdivision 8046 Acceptance of Landscape Improvements

Approve a Resolution accepting the landscape improvements including a 12-month warranty Landscape Maintenance Bond, of which the first 90 days are for maintenance, and releasing the Performance and Payment Bond for landscaping for Subdivision 8046, California Grove by KB Home, located north of Grant Street and west of Brentwood Boulevard.
On January 26, 1999, the City Council passed Resolution No. 99-42 approving the Final Map of Subdivision 8046-California Grove, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.
On August 8, 2000, the City Council passed Resolution No. 2120, accepting the offers of dedication of street rights of way, accepting the public improvements except landscaping for maintenance, accepting a performance and payment bond for landscaping and releasing the subdivision performance and payment bonds for Subdivision 8046.
The Final Map is located north of Grant Street and west of Brentwood Boulevard, and was recorded on February 5, 1999, in Book 407 of Maps, at page 33, Contra Costa County records. The subdivision contains 72 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of the street improvements found them to be completed in conformance with the approved improvement plans. The landscaping plans had not been completed and were not accepted by the City. Therefore, KB Home provided a separate Performance and Payment Bond (bond no. 24-66-40 for $40,128.00) for the landscaping improvements.
The streets were offered for dedication on the Final Map. Also, the City accepted the improvements except for the landscaping in order to obtain fee title to the roads and parcels offered on the Final Map. The developer of Subdivision 8046, KB Home, has already provided a Maintenance Bond (bond no. 111-1944-7230 for $208,500.00) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities.
At this time the landscaping improvements have been completed and the Landscaping Performance and Payment bonds can be released with acceptance of the Landscape Maintenance Bond (bond no. 226640 for $6,019.20) for the twelve-month warranty period performed by the developer, the first 90 days of which are for maintenance.
A Lighting and Landscape Maintenance District (LLD #99-4) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE LANDSCAPING FOR MAINTENANCE, ACCEPTING THE LANDSCAPE MAINTENANCE BOND, AND RELEASING THE LANDSCAPE PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 8046, CALIFORNIA GROVE BY KB HOME, LOCATED NORTH OF GRANT STREET AND WEST OF BRENTWOOD BOULEVARD
WHEREAS, On January 26, 1999 the City Council passed Resolution No. 99-42 approving the Final Map of Subdivision 8046-California Grove, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and
WHEREAS, On August 8, 2000, the City Council passed Resolution No 2120 accepting the offers of dedication of street rights of way, accepting the required public improvements except landscaping; and
WHEREAS, the required landscape improvements have been completed in conformance with the approved landscape plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the landscape improvements are hereby accepted for maintenance.
BE IT FURTHER RESOLVED that the Landscape Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
BE IT FURTHER RESOLVED that the Landscape Performance and Payment Bonds will be released within (60) days of the passage of this resolution.
