Subject/Title: Adoption of Resolution 01- authorizing the City Managerís authorized designee, the Public Works Director, to execute all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing 2001/02 Used Oil Grant funds in the amount of $7,299 and to implement and carry out the purposes specified in the grant application.

RECOMMENDATION

Adoption of Resolution 01- authorizing the City Managerís designee, the Public Works Director, to execute all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing 2001/02 Used Oil Grant funds in the amount of $7,299 and to implement and carry out the purposes specified in the grant application.

PREVIOUS ACTION

The current Used Oil Block Grant program has been a source of funding for the Cityís participation in the regional Household Hazardous Waste (HHW) free drop-off program operated at the Delta Diablo Sanitation District (DDSD) every Saturday from 9am-1pm. Cities and counties receive annual block grants based on population. The City of Brentwood has participated in previous cycles. Our current annual funding allocation is $7,299. In the last several years, we have received funding in excess of $17,000.

BACKGROUND

The people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil. The California Integrated Waste Management Board (CIWMB) offers grants to local governments to implement local used oil collection programs.

In order to take advantage of this Block Grant funding, we are required to file an annual Application prior to May 10th, 2001, and submit a resolution of approval to the execution of an agreement with the State of California. The resolution is attached and presented to the City Council for approval. If approved, staff will submit the resolution and follow through with an executed Agreement in order to secure these funds.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGERíS DESIGNEE, THE PUBLIC WORKS DIRECTOR, TO EXECUTE ALL NECESSARY APPLICATIONS, CONTRACTS, PAYMENT REQUESTS, AGREEMENTS AND AMENDMENTS HERETO FOR THE PURPOSES OF SECURING 2001/02 USED OIL GRANT FUNDS IN THE AMOUNT OF $7,299 AND TO IMPLEMENT AND CARRY OUT THE PURPOSES SPECIFIED IN THE GRANT APPLICATION.

WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and

WHEREAS, the California Integrated Waste Management Board has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program; and

WHEREAS, the applicant will enter into an agreement with the State of California for implementation of a used oil collection program;

NOW, THEREFORE BE IT RESOLVED that the _ CITY COUNCIL________ authorizes the submittal of an application to the California Integrated Waste Management Board for a 2001/02 Used Oil Recycling Block Grant. The PUBLIC WORKS_____ DIRECTOR , a designee of the City Manager, is hereby authorized and empowered to execute in the name of the CITY OF BRENTWOOD all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application. The foregoing resolution was passed by the CITY COUNCIL this 8th day of May, 2001. Effective May 8th, 2001.
