Approve a Resolution to reimburse Centex Homes from the Water Facility Fee Account for costs associated with Master Plan Facility improvements constructed in conjunction with Subdivision 8066.
The City has had water pressure problems in the past, especially in the upper elevation area of Zone I, and has been working toward a solution to these problems. As a part of the solution, the City requested Centex Homes to install a 12" Zone I waterline from Campanello Way on the east side of Marsh Creek, across the new bridge they were constructing and connect into the existing Zone I waterline at Cheshire Drive on the west side of the creek. This construction will improve the water distribution system. We have a limited number of waterline creek crossings that are needed to stabilize the water pressure throughout Zone 1.
If a break in the Zone 1 waterline were to occur at the Marsh Creek crossing on Balfour Road, the area south of Balfour Road would lose its water pressure. This waterline gives us the ability to maintain water pressure and be able to isolate certain areas without loss of water pressure. The Subdivision Map Act requires the City to reimburse the developer when requiring them to construct improvements offsite or with capacity in excess of the needs of its development. The construction of this waterline was not a condition on Centex and was not necessary for their development since they had two other points of connection for their waterlines. Centex Homes has submitted a request for payment of $65,090.50 for this additional work. Staff has reviewed the costs and backup documentation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING REIMBURSEMENT FROM THE WATER FACILITY FEE FUND TO CENTEX HOMES FOR COSTS ASSOCIATED WITH CONSTRUCTION OF OFFSITE MASTER PLAN WATER FACILITY IMPROVEMENTS
WHEREAS, the Subdivision Map Act requires Cities to reimburse Developers when requiring them to construct offsite or oversize Master Plan Facilities; and
WHEREAS, City Staff determined that additional construction was needed to improve the City's water distribution system; and
WHEREAS, certain Master Plan Facility Improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and
WHEREAS, the developer constructed the offsite improvements eligible for reimbursement.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve a reimbursement in the amount of $65,090.50 from the Water Facilities Fee Fund to Centex Homes for the offsite Water Master Plan Improvements constructed in conjunction with Subdivision 8066 as shown on attached Exhibit "A".
