Subject/Title: Accept the Dedication of the Non-potable Waterline System Construction by Roddy Ranch

RECOMMENDATION
Approve a Resolution accepting Roddy Ranch, LLC’s offer of dedication for the construction of a pump station and non-potable waterline at Deer Valley Road, Balfour Road, and Fairview Avenue, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
In June of 1993 the City Council adopted the General Plan including Chapter III – Infrastructure Element, Policy 1.4.2 – Reuse. This policy directs staff to explore ways to use secondary recycled wastewater, including irrigation, dust control, soil compaction, fire protection and to investigate new technology for the use of recycled water.

On May 11, 1999, an informational report was presented to City Council by the City Engineer concerning the non-potable water supply. The Roddy Ranch system is proposed to be added to the City’s non-potable water system through dedication and reimbursement agreement.

On February 27, 2001, City Council passed a Resolution approving the Roddy Ranch Non-Potable Waterline Reimbursement Agreement (“Agreement”), and authorizing the Mayor to execute the Agreement.

BACKGROUND
Roddy Ranch, LCC completed a non-potable water system by constructing a pump station and non-potable waterline at Deer Valley Road, Balfour Road, and Fairview Avenue in conformance with the approved improvement plans and all city standard requirements. According to section 3 of the Roddy Ranch Non-Potable Waterline Reimbursement Agreement “Ownership of Improvements”, the City shall “own the improvements after they are accepted by the City. Once the improvements are accepted and city owned. This non-potable water system will be used initially to supply ECCID surface water to Roddy Ranch, SunCal, and Brookfield Homes, for irrigation purposes. This facility will also be able to supply the City’s 8” non-potable line in Balfour Road so we can utilize untreated surface water from the ECCID canal to irrigate the City’s landscaping on Balfour Road. Ultimately, this line could be utilized by Roddy Ranch, SunCal, Brookfield Homes, and SPA ‘G’ and ‘H’ areas. Once the 20” non-potable line is constructed adjacent to Storm Line ‘A’ this spring and the new Wastewater Treatment Plant is in operation, this facility will make it possible to distribute blended tertiary treated water for irrigation purposes to comply with state requirements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING RODDY RANCH, LLC’S OFFER OF DEDICATION FOR THE CONSTRUCTION OF A PUMP STATION AND NON-POTABLE WATERLINE AT DEER VALLEY ROAD, BALFOUR ROAD, AND FAIRVIEW AVENUE, AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER



WHEREAS, in June of 1993 the City Council adopted the General Plan including Chapter III – Infrastructure Element, Policy 1.4.2 – Reuse. WHEREAS, on May 11, 1999, a Non-Potable Water System informational report was presented to City Council by the City Engineer. The Roddy Ranch system is proposed to be added to the City’s non-potable water system through dedication and reimbursement agreement; and

WHEREAS, the work is in conformance with the approved improvement plans, all City standard requirements have been completed and the work is now ready for acceptance; and

WHEREAS, according to section 3 of the Roddy Ranch Non-Potable Waterline Reimbursement Agreement “Ownership of Improvements”, the City shall “own the improvements after they are accepted by the City; and

WHEREAS, once the improvements are accepted and city owned, this non-potable water system will be used to supply ECCID surface water to Roddy Ranch, SunCal, and Brookfield Homes, for irrigation purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the work performed by Roddy Ranch LLC for the construction of a pump station and non-potable waterline at Deer Valley Road, Balfour Road, and Fairview Avenue, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION


NOTICE IS HEREBY GIVEN THAT:


THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 27th day of February, 2001 enter into an agreement with Roddy Ranch, LLC, for the construction of a pump station and Non-Potable waterline at Deer Valley Road, Balfour Road, and Fairview Avenue per the plans approved by the City Engineer on June 18, 1999.

The work described in the agreement was to furnish all material, labor, and equipment necessary to complete said project.

The surety on said agreement is held by American Casualty Company of Reading, PA.

On the 10th day of April, 2001, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
