RECOMMENDATION
Adopt an Ordinance to approve an amendment to the City of Brentwood Municipal Code Chapter 2.24 Personnel System, section 2.24.030 Applicability of system, to update and clarify its terms.

PREVIOUS ACTION
City Council adopted Ordinance 187 in 1969 establishing Chapter 2.24 Personnel System within the Brentwood Municipal Code.

BACKGROUND
Subsequent to the adoption of Ordinance 187, as an extension of the Personnel System, the City Council adopted an Employee Handbook that details specific property rights that apply to Regular, Classified employees employed by the City of Brentwood. 

With the addition of an in-house City Attorney, the terms of the Brentwood Municipal Code require clarification. The recommended revisions to the Brentwood Municipal Code Chapter 2.24 Personnel System, section 2.24.030 Applicability of system are declaratory only and are intended to provide additional clarification.

ORDINANCE NO.


AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING AN AMENDMENT TO THE BRENTWOOD MUNICIPAL CODE CHAPTER 2.24 PERSONNEL SYSTEM, SECTION 2.24.030 APPLICABILITY OF SYSTEM.


WHEREAS, the City Council established Chapter 2.24 Personnel System as part of the Brentwood Municipal Code when Ordinance 187 was adopted in 1969; and

WHEREAS, sub-section 2.24.030 applicability of system is outdated and employee classifications and staff were adopted in 1969; and

WHEREAS, property rights are defined in the Employee Handbook and apply to Regular Full-time, Classified employees; and

WHEREAS, positions in the Unclassified Service category include the City Manager, City Attorney and Department Heads who in the absence of defined property rights are presumed to have no such rights; and

WHEREAS, the following revisions to the Brentwood Municipal Code are declaratory only and are intended to provide additional clarification.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby ordain as follows: (added text underlined, deleted text stricken)

Section 1.

Section 2.24.030 Applicability of system is hereby amended as follows:

The personnel system shall apply to all regular, full-time employees of the City of Brentwood except the city administrator manager, city attorney and all department heads.

Section 2. This Ordinance shall take effect 30 days after the date of its adoption, and prior to the expiration of 30 days from the passage thereof shall be published at least once in the Brentwood News, a newspaper of general circulation, published and circulated in the City of Brentwood and thenceforth and thereafter the same shall be in full force and effect.

The foregoing Ordinance was introduced, with full reading waived, by the City Council of the City of Brentwood.
