RECOMMENDATION
Approve a Resolution approving and authorizing the City Manager to execute Program Supplement Agreement No. 002-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening Project, CIP Project No. 336-3056.

PREVIOUS ACTION
On May 26, 1998, the City of Brentwood approved an updated Master Agreement, Administering Agency-State Agreement for Federal Aid Projects, 04-5300.

BACKGROUND
The City of Brentwood was awarded federal funding for the Walnut Boulevard Widening Project, CIP. Project No. 336-3056 commencing with the 1997/98 fiscal year. Authorization to proceed with preliminary engineering for the project was received in late 1999. As part of the preliminary engineering, environmental certification must be approved by CalTrans. Several buildings in the middle of the project area have been determined to be fifty years or older so the project must go through a lengthy historic property review by the State Historic Preservation Office. The time required for the historic property review means that the environmental process cannot be completed in time to receive authorization for construction by the deadline of March 20, 2001.

Since the deadline cannot be met due to the required environmental studies, CalTrans has agreed to shift funding from the Walnut Boulevard Widening Project to the Brentwood Boulevard Widening Project (CIP Project No. 336-3054), but will allow the City to invoice for costs for preliminary engineering which the City has already incurred for the Walnut Boulevard project.

In order to invoice for the funds, a Program Supplement specific to the Walnut Boulevard project must be approved and executed by the City.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE PROGRAM SUPPLEMENT AGREEMENT NO. 002-M TO THE ADMINISTERING AGENCY-STATE AGREEMENT FOR FEDERAL-AID PROJECTS (MASTER AGREEMENT) NO. 04-5300


WHEREAS, the Master Agreement between the City of Brentwood and the State of California for federal-aid projects was approved by the City of Brentwood on May 26, 1998; and

WHEREAS, implementation of the program is through the Department of Transportation (CalTrans); and

WHEREAS, it has been determined that the City of Brentwood is entitled to partial reimbursement of the eligible costs for preliminary engineering for the Walnut Boulevard Widening Project (CIP Project No. 336-3056); and

WHEREAS, the City may apply for reimbursement of eligible costs, upon approval by CalTrans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that Program Supplement Agreement No. 002-M to Administering Agency-State Agreement No. 04-5300 is approved and authorized for execution by the City Manager.
