Subject/Title: Subdivision 6665 Final Map Acceptance

RECOMMENDATION
Approve a Resolution approving the Final Map of Subdivision 6665 (William Lyon Homes, Inc.) located north of Nancy Street and east of Brentwood Boulevard (State Highway 4), accepting the improvement security, approving the Subdivision Improvement Agreement, and authorizing the Mayor and City Clerk to execute the same.

PREVIOUS ACTION
On March 3, 1987, by Resolution No. 87-10, the Planning Commission approved Tentative Subdivision Map 6665, with conditions.

BACKGROUND
The Final Map is located north of Nancy Street and east of Brentwood Boulevard. This Final Map has been checked for conformance with the approved Tentative Map and Conditions of Approval. The developer has executed a Subdivision Improvement Agreement, the appropriate improvement securities (Faithful Performance and Labor & Materials Bonds for On-Site improvements Bond No.3SM 984 922 00 for the amount of $1,809,000.00; for Off-Site Storm Drain Bond No 3SM 986 241 00 for the amount of $448,200.00 and Off-Site Sanitary Sewer Bond No 3SM 986 240 00 for the amount of $ 310,500.00) have been posted, and offers of dedication for the appropriate roadways and easements have been made.

In order for the Final Map to be recorded, the Council needs to approve both the Final Map and the Subdivision Improvement Agreement, accept the offers of dedication as shown on the map subject to acceptance of the improvements, accept the improvement securities, and authorize the Mayor and City Clerk to execute the Subdivision Improvement Agreement.

The developer is responsible for necessary repairs to subdivision improvements for a period of 12 months following acceptance of the improvements for maintenance. The City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. Lighting and Landscape Maintenance District 00-2 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE FINAL MAP OF SUBDIVISION 6665 (WILLIAM LYONS HOMES, INC.), LOCATED NORTH OF NANCY STREET AND EAST OF BRENTWOOD BOULEVARD, ACCEPTING THE OFFERS OF DEDICATION SHOWN THEREON SUBJECT TO ACCEPTANCE OF IMPROVEMENTS, ACCEPTING THE IMPROVEMENT SECURITIES, APPROVING THE SUBDIVISION IMPROVEMENT AGREEMENT, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE SAME.



WHEREAS, on March 3, 1987, by Resolution No. 87-10, the Planning Commission approved the Tentative Map of Subdivision 6665, with conditions; and

WHEREAS, on December 13, 1988, by Ordinance No 426, the City Of Brentwood and Countryside Properties relative to the development known as Countryside (Subdivision No 6665) entered into a Development Agreement; and

WHEREAS, on June 8, 1992, by Ordinance No 513, the First Amendment to the Development Agreement was passed and adopted by the City Council; and

WHEREAS, Final Map 6665 showing 81 lots has been prepared for this subdivision; and

WHEREAS, City staff has checked the Final Map for conformance with the approved Tentative Map and the Conditions of Approval dated March 3, 1987, and finds that the Final Map is ready for approval.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the Final Map for Subdivision 6665, and that the offers of dedication shown thereon are hereby accepted subject to acceptance of improvements.

BE IT FURTHER RESOLVED that the Subdivision Improvement Agreement is hereby approved, that the improvement securities accompanying said agreement are hereby accepted, and that the Mayor and City Clerk are hereby authorized to execute said Subdivision Improvement Agreement.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 9th day of January, 2001 by the following vote:
