CITY COUNCIL AGENDA ITEM NO. 4

Meeting Date: January 9, 2001

Subject/Title: Acceptance of Improvements for Subdivision 8081, Blackhawk

Submitted by: Engineering: J. Stevenson/B. Grewal/D. Boskovic

Approved by: Jon Elam, City Manager

RECOMMENDATION
Approval of a Resolution accepting the offers of dedication of parcels A, B, C, D and E for ingress and egress by emergency vehicles, all areas marked as “P.S.E.” (public service easements) for public use of the private streets and parcels A (Summerset Dr.), B (Kent Dr.), C (Rubidoux Terrace), D (Grenadier Way) and E (Kent Dr.) for public services and utility purposes and “S.D.E” (storm drain easements) as shown on the Final Map, and accepting public improvements for maintenance, accepting the subdivision Maintenance Bond and releasing the subdivision Performance and Payment Bonds for Subdivision 8081, Blackhawk, located west of Fairview Avenue and south of Balfour Road.

PREVIOUS ACTION
On December 9,1997, by Resolution No. 97-241, City Council approved the Final Map of Subdivision 8081, with improvement securities and subdivision improvement agreement.

BACKGROUND
The Final Map is located south of Balfour Road and west of Fairview Avenue and was recorded on January 22,1998, in Book 398 of Maps, at page 11, Contra Costa County records. The subdivision contains 100 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of parcels A, B, C, D and E for ingress and egress by emergency vehicles, all areas marked as “P.S.E.” (public service easements) for public use of the private streets for public services and utility purposes and “S.D.E” (storm drain easements) found them to be completed in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to the acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The developer of Subdivision 7939, Blackhawk, has already provided a Maintenance Bond (Bond No. 430896S for amount of $187,829.25) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. Lighting and Landscaping District 94-1 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
