Approval of a Resolution approving a Reimbursement Agreement with Beck Properties
Inc. for costs associated with Master Plan Facility improvements.
On April 12, 1994, the City Council passed Resolution No. 94-63, which established
a standard reimbursement agreement for Master Plan Facility Improvements.
On June 19, 1990, the Planning Commission of the City of Brentwood adopted
Resolution No. 90-16, which approved Tentative Map 7474. Conditions of Approval
for this map required the Developer to construct certain Master Plan Facility
Improvements. Master Plan Facility Improvements are those improvements that
have been identified in the Master Infrastructure element of the General Plan.
The Subdivision Map Act requires the City to enter into a Reimbursement Agreement
when requiring a developer to construct improvements with capacity in excess
of the needs of their development alone. This agreement covers both subdivisions
included under Tentative Map 7474. The reimbursement calculations are based
on the City of Brentwood 1999 Development Fee Program, taking into account
the fee credits for earthwork that Contra Costa Flood Control will be issuing
the developer. The items that qualify for reimbursement are the following trail
improvements: asphalt only for a trail/maintenance road at the detention basin,
the trail to the soccer field at the detention basin, completion of the concrete
trail under Apple Hill Bridge and a section of trail along CCWD/PG&E's
right of way, on the western boundary of the subdivisions.

A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF BRENTWOOD APPROVING A REIMBURSEMENT AGREEMENT
WITH BECK PROPERTIES INC. FOR SUBDIVISIONS 7474 AND 8368 FOR COSTS
ASSOCIATED WITH MASTER PLAN FACILITY IMPROVEMENTS.
WHEREAS, in June 1990 the Planning Commission of the City
of Brentwood adopted Resolution No. 90-16 which required the Developers
of Tentative Subdivision 7474 to make certain Master Plan Facility
WHEREAS, certain Master Plan Facility improvements are reimbursable
under the City of Brentwood Master Plan Facility Fee Program; and
WHEREAS, the developer will construct the improvements eligible
NOW, THEREFORE BE IT RESOLVED that the City Council of the
City of Brentwood does hereby approve a Reimbursement Agreement with
Beck Properties Inc. for Master Plan Improvements constructed in
conjunction with Subdivisions 7474 and 8368, covered under Tentative
Subdivision Map No. 7474, as shown on attached Exhibit ‘A’.
