Subject/Title: Agricultural Enterprise Program Potential Reconsideration and/or Ballot Measure

RECOMMENDATION
Following Council discussion, direct staff to return with a reconsideration of the Agricultural Enterprise Program, and/or language for a ballot measure.

PREVIOUS ACTION
On November 14, 2000, the Council deadlocked 2 – 2 on adoption or continuance of the Agricultural Enterprise Program. Consideration of a potential ballot measure on this item was also requested as a future agenda item. Councilmembers McPoland and Young have also requested the Program return to Council for reconsideration, independent of a ballot measure.

BACKGROUND
Although no action was taken on the Agricultural Enterprise Program by Council on November 14th, due to the 2 – 2 split vote, there remains interest at Council of moving forward on this. At this time, there appear to be at least three options for Council consideration:

1. Reconsider adoption of the Program as recommended on November 14th, and direct staff to return to Council for a new public hearing at the earliest possible Council meeting; or

2. Reconsider the Program, and first continue discussions with farmers on their concerns, prior to returning to Council for adoption; and/or

3. Direct staff to prepare language for placing the Program on a future election ballot.

First, Council should decide whether or not they want to reconsider and select either option 1 or 2 above. In either case, the Program would return for a noticed public hearing at a future date. Then, Council should decide if they also want to have staff prepare a ballot measure and return with that for Council review at a later date.
