Subject/Title: Approve a Purchase Agreement with Centex Homes for a Trail Head

RECOMMENDATION
Approval of a Resolution approving an Agreement for purchase of a fee parcel for a trail head (Trail Head Purchase – Centex Development, CIP Project No. 522-5218), with Centex Homes, a Nevada General Partnership, for real property known as Lots 64 & 65 of Subdivision 8066 identified as APN, 010-490-015 & 016, hereby accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the deed.

PREVIOUS ACTION
On September 26, 2000, the City Council approved Resolution No. 2159 establishing a Capital Improvement Project for the Trail Head Purchase – Centex Development (CIP Project No. 522-5218) and directing staff to develop an agreement for purchase of property.

BACKGROUND
This purchase is necessary for the safe accessibility of the trail for users from the subdivision across Marsh Creek to Creek Side Park and connections through the City.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL (TRAIL HEAD PURCHASE – CENTEX DEVELOPMENT, CIP PROJECT NO. 522-5218), WITH CENTEX HOMES, A NEVADA GENERAL PARTNERSHIP, FOR REAL PROPERTY KNOWN AS LOTS 64 & 65 OF SUBDIVISION 8066 IDENTIFIED AS APN, 010-490-015 & 016, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED

WHEREAS, on September 26, 2000, the City Council approved Resolution No. 2159 establishing a Capital Improvement Project for the Trail Head Purchase – Centex Development (CIP Project No. 522-5218) and directing staff to develop an agreement for purchase of property; and

WHEREAS, real property known as Lots 64 & 65 of Subdivision 8066 and identified as APN 010-490-015 & 016 in the City of Brentwood, that is owned by Centex Homes, a Nevada General Partnership, is needed for the trail head project; and

WHEREAS, a Purchase Agreement between the City of Brentwood and the vested property owners has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Purchase Agreement is hereby approved.

BE IT FURTHER RESOLVED the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the Agreement and any related escrow documents including acceptance of the Grant Deed.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 11th day of November 2000, by the following vote:
