Subject/Title: Acceptance of Improvements for Subdivision 8138, Signature

RECOMMENDATION
Approval of a Resolution accepting the offers of dedication of the street right-of-ways for Goerke Street, Boltzen Street, Boltzen Court, George Court, and Craig Court, accepting public improvements for maintenance accepting the subdivision Maintenance Bond and releasing the subdivision Performance and Payment Bonds for Subdivision 8138, Signature, located west of Sellers Avenue and south of Chestnut Street.

PREVIOUS ACTION
On October 13, 1998, by Resolution No. 98-173, City Council approved the Final Map of Subdivision 8138, with improvement securities and subdivision improvement agreement.

BACKGROUND
The Final Map is located south of Chestnut Street and west of Sellers Avenue and was recorded on October 27, 1998, in Book 403 of Maps, at page 46, Contra Costa County records. The subdivision contains 68 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of the street improvements found them to be completed in conformance with the approved improvement plans. Also, installation of waterline connection to Redhaven Street has been completed and approved by the City Inspector.

The streets were offered for dedication on the Final map. The streets offered for dedication include Goerke Street, Boltzen Street, Boltzen Court, George Court, and Craig Court. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to the acceptance of improvements. Now that the streets are improved, the City must accept the improvements in order to obtain rights to the roads and parcels offered on the final map. The developer of Subdivision 8138, Signature, has already provided a Maintenance Bond (Bond No.3SM 91542900-A for the amount of $130,309.00) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. Lighting and Landscaping District 95-8, has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION OF STREET RIGHT-OF-WAYS FOR GEORKE STREET, BOLTZEN STREET, BOLTZEN COURT, GEORGE COURT, AND CRAIG COURT AND ALL EASEMENTS AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 8138, SIGNATURE, LOCATED WEST OF SELLERS AVENUE AND SOUTH OF CHESTNUT STREET

WHEREAS, on October 13,1998, the City Council passed Resolution No 99-173 approving the Final Map of Subdivision 8138 - Signature, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements, including the installation of deferred waterline to Redhaven Street, have been completed in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements, including the waterline to Redhaven Street, are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for the following streets: Georke Street, Boltzen Street, Boltzen Court, George Court, and Craig Court, and all easements as shown on the Final Map.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 14th day of November 2000 by the following vote:
