RECOMMENDATION
Approval of a Resolution accepting the offers of dedication of the street right-of-ways for Empress Lane, Dawn Drive, Legend Lane, Camden Court, Regal Drive, and Fairview Avenue widening, accepting Parcel ‘B,’ accepting public improvements for maintenance (excluding Fairview Avenue landscaping and EBMUD right-of-way landscaping with the soundwall), accepting the subdivision Maintenance Bond and releasing the subdivision Performance and Payment Bonds for Subdivision 8055, Hofmann, located in SPA ”L”, east of Fairview and south of Lone Tree Way.

PREVIOUS ACTION
On July 27, 1999, by Resolution No. 99-181, City Council approved the Final Map of Subdivision 8055, with improvement securities and subdivision improvement agreement.

BACKGROUND
The Final Map is located south of Lone Tree Way and east of Fairview Avenue and was recorded on August 12, 1999, in Book 413 of Maps, at page 15, Contra Costa County records. The subdivision contains 65 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds for these improvements. A final inspection of the street improvements found them to be completed in conformance with the approved improvement plans.

Fairview Avenue landscaping and EBMUD right of way landscaping with the soundwall have not yet been completed, so the associated bond for these improvements cannot be released at this time.

The streets were offered for dedication on the Final map. The streets offered for dedication include Empress Lane, Dawn Drive, Legend Lane, Camden Court, Regal Drive, and Fairview Avenue widening. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to the acceptance of improvements. Now that the streets are improved, the City must accept the improvements in order to obtain rights to the roads and parcels offered on the final map. The developer of Subdivision 8055, Hofmann, has already provided a Maintenance Bond (Bond No. 11133389988M for $262,800.00) to cover the twelve-month warranty period for these improvements. After the twelve months, the City will then incur costs, the amount of which is unknown at this time, associated with street sweeping and necessary repairs to streets and/or utilities. Lighting and Landscape District 99-3, has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION OF STREET RIGHT-OF-WAYS FOR EMPRESS LANE, DAWN DRIVE, LEGEND LANE, CAMDEN COURT, AND FAIRVIEW AVENUE WIDENING; PARCEL ‘B’, AND ALL EASEMENTS AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE (EXCLUDING FAIRVIEW AVENUE LANDSCAPING AND EBMUD RIGHT-OF-WAY LANDSCAPING WITH THE SOUNDWALL), ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION 8055, HOFMANN LOCATED EAST OF FAIRVIEW AVENUE AND SOUTH OF LONE TREE WAY

WHEREAS, on July 27,1999, the City Council passed Resolution No, 99-181 approving the Final Map of Subdivision 8055, Hofmann, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements, excluding Fairview Avenue landscaping, EBMUD right-of-way landscaping with the soundwall, have been completed in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (excluding Fairview Avenue landscaping and EBMUD right-of-way landscaping with the soundwall), are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for the following streets: Empress Lane, Dawn Drive, Legend Lane, Camden Court, and Fairview Avenue widening; parcel ‘B’, and all easements as shown on the Final Map.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 14th day of November 2000 by the following vote:
