RECOMMENDATION
Approval of a Resolution approving a Reimbursement Agreement with Brentwood Balfour Partners, LLC for costs associated with Master Plan Facility improvements.

PREVIOUS ACTION
On April 12, 1994, Council Passed Resolution 94-63, which established a standard Reimbursement Agreement for Master Plan Facilities improvements.

BACKGROUND
On 1992, the Planning Commission of the City of Brentwood adopted Resolution 92-22, which approved Tentative Subdivision Map 7736. Conditions of Approval for this map required the developer to make certain Master Plan Facility Improvements. Master Plan Facility Improvements are those improvements that have been identified in the Master Infrastructure element of the General Plan. These facilities are considered backbone infrastructure and form the basis of the facility fee structure. Under most circumstances when these improvements are required to be constructed by a developer, they would provide capacity in excess of the needs of their development alone. The Subdivision Map act requires the City enter a reimbursement agreement when requiring the developer to construct improvements with excess capacity. The improvements which qualify as excess capacity are off-site roadway improvements north on Walnut Blvd., one-half street adjacent to two sides of the park (as stated in the Development Agreement), 5.15 acre neighborhood park, pre-payment of fees for roadway, water and wastewater treatment facilities. The attached reimbursement agreement also includes fee credits for roadway facilities assigned to Brentwood Balfour Partners from Nunn/Baez (per letter dated May 19, 2000)

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A REIMBURSEMENT AGREEMENT WITH BRENTWOOD BALFOUR PARTNERS, LLC, A DELAWARE LIMITED LIABILITY COMPANY, SUBDIVISIONS 8411 & 8383, FOR COSTS ASSOCIATED WITH MASTER PLAN FACILITY IMPROVEMENTS


WHEREAS, in 1992, the City of Brentwood Planning Commission, adopted Resolution No. 92-22 which required the developers of Tentative Subdivision No. 7736 to make certain Master Plan Facility Improvements; and

WHEREAS, certain Master Plan Facility Improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and

WHEREAS, the developer will make improvements eligible for reimbursement.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the Reimbursement Agreement with Brentwood Balfour Partners LLC, a Delaware Limited Liability Company for Master Plan Improvements to be constructed in conjunction with Subdivisions 8411 & 8383, covered under Tentative Map 7736 as shown on attached Exhibit "A" of the reimbursement agreement.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 10th day of October 2000 by the following vote:
