RECOMMENDATION
Approval of a Resolution approving a Reimbursement Agreement with Morrison Homes, Inc. for costs associated with Master Plan Facility improvements.

PREVIOUS ACTION
The Developer previously owned property within the boundaries of Subdivisions 8069 and 8225 included within Vesting Tentative Map No. 8069.

BACKGROUND
On March 17, 1998, the City of Brentwood Planning Commission approved Tentative Map 8069. As one of the conditions to the subdivision approval, City required Developer to design, construct, bond, finance and install a portion of offsite Master Plan Trail Improvements and to design Heritage Park. The City agreed that the Developer would construct Heritage Park. The Heritage Park Improvements are identified in the Brentwood Capital Improvement Costs and Basis of Development Fees dated July 27, 1999. Developer is willing to advance the costs of constructing, installing, bonding, permitting, financing and inspecting Heritage Park subject to fee credits previously received and cash reimbursement by progress payment as indicated in Section 3.3 of the Reimbursement Agreement. The total remaining reimbursement of this agreement is $419,961.49. Morrison Homes, Inc. and Hofmann Land Development will each be constructing their own sections of the Heritage Trail, beginning north of the park, continuing through the park and ending south of the park.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A REIMBURSEMENT AGREEMENT WITH MORRISON HOMES INC. FOR COSTS ASSOCIATED WITH MASTER PLAN FACILITY IMPROVEMENTS.



WHEREAS, in April 1994 the City Council of the City of Brentwood adopted Resolution No. 94-63 which established a standard Reimbursement Agreement for Master Plan Facilities Improvements; and

WHEREAS, certain Master Plan Facility improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and

WHEREAS, the developer will construct the improvements eligible for reimbursement.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve a Reimbursement Agreement Morrison Homes Inc. for Master Plan Improvements constructed in conjunction with Subdivisions 8069 and 8225, covered under Tentative Subdivision Map No. 8069 as shown on attached Exhibit ‘A’.
