Subject/Title: Transfer of specific Delta Community Services, Inc. positions from Delta Community Services, Inc. to the City of Brentwood Parks and Recreation Department, effective October 16, 2000

RECOMMENDATION
Adopt a Resolution transferring positions identified in the Resolution from Delta Community Services, Inc. (“DCS”) to City of Brentwood employee status.

PREVIOUS ACTION
The City Council of the City of Brentwood unanimously passed a motion approving a partnership between Delta Community Services, Inc. and the City of Brentwood at the City Council meeting held on August 22, 2000.

BACKGROUND
At the August 22, 2000, City of Brentwood City Council meeting, staff presented an operation plan for DCS for the future. The plan was developed over several months with input from City and Center staff, the City Council Sub-committee and Community Center Board Members.

The attached resolution addresses the transfer of specific DCS staff that will become employees of the City of Brentwood Parks and Recreation Department. The terms and conditions of employment concerning existing DCS staff are part of the attached Resolution. These terms and conditions are consistent with the terms and conditions that were applied when the City of Brentwood merged with the Brentwood Recreation & Park District. 

Salary and benefits will be adjusted for the current Executive Director who will assume the classification title of Recreation Supervisor and will be placed on step A of the salary range $3,599 - $4,375 per month. Total compensation costs for this position including salary and mandatory benefits (taxes) paid by DCS from July 1, 2000 through October 15, 2000 and the new salary and benefits paid by the City of Brentwood beginning October 16, 2000 through June 30, 2001 total approximately $59,200. 

The remaining Delta Community Services, Inc. staff occupy hourly, temporary or contract positions. The transfer of these positions to the City of Brentwood will not result in additional expenditures.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE TRANSFER OF SPECIFIC DELTA COMMUNITY SERVICES, INC. POSITIONS FROM DELTA COMMUNITY SERVICES, INC. TO THE CITY OF BRENTWOOD PARKS AND RECREATION DEPARTMENT, EFFECTIVE OCTOBER 16, 2000. 


WHEREAS, the City Council approved the concept of a partnership between Delta Community Services, Inc. and the City of Brentwood Parks and Recreation Department at the City Council meeting held on August 22, 2000, and

WHEREAS, the City and Delta Community Services, Inc. agree to the following terms and conditions concerning existing staff employed by Delta Community Services, Inc.:

1. The existing full-time Executive Director shall become a regular employee of the City effective October 16, 2000. The employee will be classified as a Recreation Supervisor with salary set at step A, $3,599/month. To the extent allowed by law and the City’s benefit providers, this employee shall be immediately eligible for regular employee benefits, including, but not limited to: Vacation, Sick, Medical, Dental, Long Term Disability, Vision, Life Insurance, PERS and ICMA, and shall receive credit for his years of service with Delta Community Services, Inc., relative to his eligibility for City benefits. For the purpose of initial City employment resulting from this order, this current full-time Delta Community Services, Inc., employee shall not be subject to any probationary period of employment nor testing as provided in the City’s employee handbook but otherwise shall be subject to all current and future City personnel policies.
2. The existing hourly Senior Activity Coordinator shall become a part-time, hourly employee of the City effective October 16, 2000. This position works 10-15 hours per week and is not eligible for City benefits.
3. The Administrative Assistant and the Office Assistant shall become temporary, part-time, hourly employees of the City upon the effective date of this order. These two 20-hour per week positions are temporary positions that will end effective December 31, 2000. These two temporary, hourly positions are not eligible for City benefits, however, the City will continue to honor the employment agreement that was made between the employees and Delta Community Services, Inc. and will continue to provide pro-rated sick leave and vacation accrual during the term of their employment. 
4. The three part-time, hourly Center Supervisors shall become part-time, hourly employees of the City upon the effective date of this order. These employees work part-time, intermittent evening and weekend hours as assigned and are not eligible for City benefits. 
5. The two contract, grant-funded employees will remain as employees of Delta Community Services, Inc. and will not be eligible for benefits or payroll through the City of Brentwood.

NOW, THEREFORE BE IT RESOLVED the City Council of the City of Brentwood, approves the transfer of staff detailed in items 1 through 4 listed above, from Delta Community Services, Inc. to the City of Brentwood Parks and Recreation Department, effective October 16, 2000.
