Subject/Title: Sewer and Water Agreements for the area south of Neroly/Delta Road

RECOMMENDATION
Approval of a Resolution authorizing the City Manager to sign agreements with Diablo Water District and Ironhouse Sanitary District upon recommendation of the City Attorney and the City Engineer, and directing staff to incorporate the associated costs into the Development Fee Program at the next annual update, currently scheduled for October 10, 2000.

BACKGROUND
Currently public sewer and water services are not provided by any agency in the area north of Lone Tree Way. The area is generally within the service area of Diablo Water District and Ironhouse Sanitary District. However, some areas have been or are in the process of being annexed into the City limits of Brentwood. Brentwood also has sewer and water services and the developers and residents of this area have requested service from Brentwood.

The developers and residents have made application to LAFCO to de-annex from DWD and Ironhouse in order to be served by Brentwood. LAFCO is considering the application and has directed the City, DWD and Ironhouse to arrive at some resolution of this matter. Agreements that would facilitate Brentwood serving sewer and water in this area are being negotiated with the staff of both agencies and City staff recommends that the Council authorize the City Manager to sign the agreements upon the recommendation of the City Attorney and the City Engineer. The agreements are not in final form as of the date of this writing. However, they are expected to be in final form by the date of the Council meeting. In the event that the staffs do not reach final form and content in time for Council action, this action will allow the City Manager to sign the agreements once staff is satisfied with the content.

The costs associated with these agreements will be paid by the developers and residents with their connection fees. Therefore, there is no direct cost to the City associated with these agreements.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO SIGN AGREEMENTS WITH THE DIABLO WATER DISTRICT AND IRONHOUSE SANITARY DISTRICT TO SERVE THE AREA SOUTH OF THE NEROLY ROAD/DELTA ROAD LINE.


WHEREAS, the area south of the Neroly Road/Delta Road line is currently within the Diablo Water District and Ironhouse Sanitary District service areas; and

WHEREAS, this area is being annexed into the City of Brentwood; and

WHEREAS, Brentwood has its own sewer and water service that is capable of servicing this area; and

WHEREAS, the developers and property owners within the area have petitioned LAFCO to de-annex from the special districts and into the City service area; and

WHEREAS, the City desires to serve its citizens and businesses sewer and water that it controls; and

WHEREAS, LAFCO has directed the City and special districts to negotiate resolution of the provision of sewer and water service in this area; and

WHEREAS, the City and special districts all agree that agreements can be prepared that will be fair and equitable to the City, the special districts and the future citizens and businesses of the area.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the City Manager is authorized to execute the agreements with Diablo Water District and Ironhouse Sanitary District upon the recommendation of the City Attorney and the City Engineer in substantially the same form as presented to the City Council.

BE IT FURTHER RESOLVED that City staff is hereby directed to incorporate the appropriate costs into the Development Fee Program at the next annual update, currently scheduled for October 10, 2000.
