RECOMMENDATION
Approve a Resolution that authorizes a one-time exception to Council Administrative Policy No. 20-12, Sick Leave – Conversion to Deferred Compensation/cash at Retirement.

The City Council Personnel Sub-committee reviewed and approved the request submitted by the employee. 


BACKGROUND
In the Fall of 1999, staff met with the City Council Personnel Sub-committee to discuss a request presented by a retiring employee to convert a part of his unused sick leave to cash for deposit to the employee’s deferred compensation account. This request was based on the employee’s limited use of sick leave over his long term of employment with the City of Brentwood. 

The Personnel Sub-committee agreed that it is reasonable to recognize and reward a retiring long term employee that has not used much of the sick leave accrued during their term of employment with the City of Brentwood. The Sub-committee felt a retiring employee that has not used more than one quarter of the sick leave accrued could be rewarded with the conversion of sick leave accrual to cash. This particular employee is eligible to utilize the “catch-up” provision of the deferred compensation plan and he requested a cash conversion of $15,000 for deposit to his deferred compensation account.

Beginning with Fiscal Year 2001/02, the Finance Department will budget for the full financial value of accrued sick leave for all employees. Funding of the current request is available through salary savings due to vacant positions paid from the General Fund.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING EXCEPTION TO COUNCIL/ADMINISTRATIVE POLICY NO. 20-12, SICK LEAVE – CONVERSION TO DEFERRED COMPENSATION/CASH AT RETIREMENT


WHEREAS, the City Council Personnel Sub-committee reviewed a request from a long-term employee to receive cash conversion of a portion of sick leave hours he accrued over his employment for deposit to his deferred compensation account, and

WHEREAS, the employee worked for the City of Brentwood for approximately thirty-one years, and 

WHEREAS, over the past thirty-one years the employee accrued approximately 2,880 hours of sick leave and used less than 13% of the total sick leave accrual, and

WHEREAS, the request is for the conversion to cash for deposit to deferred compensation in the amount of $15,000 which is the equivalent of approximately 350 hours of sick leave accrual, and

WHEREAS, the Sub-committee agreed that the employee should receive recognition for the limited use of sick leave accrual over the last 31 years and that the request should be granted.

NOW, THEREFORE BE IT RESOLVED the City Council of the City of Brentwood, approves this one-time exception to Council/Administrative Policy No. 20-12, Sick Leave – Conversion to Deferred Compensation/Cash at Retirement, for retiring Police Lieutenant, Manuel Misquez.
