RECOMMENDATION
Passage of a Resolution authorizing the City Manager to execute Program Supplement Agreement No’s. SB98-5300(011), SB98-5300(013), SB98-5300(018), and SB99-5300(007) to State-Local Partnership Program Agreement SLTPP-5300 for State reimbursement of four transportation construction projects.

PREVIOUS ACTION
On January 26, 1993, the City Council passed Resolution No. 93-08 approving a master agreement with the State of California Department of Transportation (CalTrans) for partial reimbursement for local transportation construction projects.

BACKGROUND

The State-Local Transportation Partnership Program (SLTPP) was implemented in 1989 to assist local agencies to fund and construct transportation improvement projects. The reimbursement ration has varied from year to year depending on the total eligible cost of all eligible projects that have been nominated by local agencies. The reimbursement ratio for projects in Cycle 8 is 24.54% and 16.59% for Cycle 9 projects. The projects approved by CalTrans for reimbursement are:

· Fairview Avenue Improvements - Central Boulevard to Sand Creek Road. $214,397
· Minnesota Avenue Improvements at Central Boulevard. $30,027
· 1998 PMP, CIP Project 33683, now 336-3083 $63,286
· 1999 PMP, CIP Project 336-3083 $99,706
Total Eligible Reimbursement $407,416

The City is required to execute program supplements to the master agreement and pass a resolution identifying the projects and official authorized to execute the documents on behalf of the City in order to receive reimbursement.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE PROGRAM SUPPLEMENT AGREEMENTS TO THE STATE-LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP-5300.



WHEREAS, Senate Bill 300 provided for State participation in the funding of certain local transportation projects; and

WHEREAS, implementation of the program is through the Department of Transportation (CalTrans); and

WHEREAS, the City of Brentwood is entitled to partial reimbursement of the eligible costs for the following projects:

· SB98-5300(011) $214,397
Fairview Avenue Improvements - Central Boulevard to Sand Creek Road. This project was incorporated into conditions of approval of more than one developer.

· SB98-5300(013) $30,027
Minnesota Avenue Improvements at Central Boulevard. This project was incorporated into conditions of approval of developer.

· SB98-5300(018) $63,286
1998 Pavement Management Program, CIP Project 33683, now 336-3083

· SB99-5300(007) $99,706
1999 Pavement Management Program, CIP Project 336-3083; and

WHEREAS, the City may apply for reimbursement of eligible construction costs, upon approval by Caltrans; and

WHEREAS, in accordance with Senate Bill 300, the City and Caltrans entered into the State-Local Transportation Partnership Program Agreement for State Share funds on February 8, 1993 for subsequent projects.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that Program Supplement Agreement No’s. SB98-5300(011), SB98-5300(013), SB98-5300(018), and SB99-5300(007) to the State-Local Transportation Partnership Program Agreement be approved and authorized for execution by the City Manager.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of September, 2000 by the following vote:
