Subject/Title:    Quitclaim a portion of Parcel B Apple Hill Estates Phase II

 RECOMMENDATION

Approval of a resolution authorizing the City Manager to execute a Quitclaim Deed transferring any interest the City of Brentwood may have in a parcel identified as a portion of Parcel B Park Easement Subdivision No. 7642 Apple Hill Estates Phase II filed May 19, 1994 in Book 372 of Maps at Page 25, in the Office of the Recorder of Contra Costa County, California, to Apple Hill Association, a California non-profit mutual benefit corporation.

 PREVIOUS ACTION

None 

BACKGROUND

The City has received a request that ownership of a portion of the park easement that lies adjacent to their clubhouse be transferred to Apple Hill Association.  The requested portion of the park easement has been maintained by Apple Hill for over a year. 

Staff recommends the requested portion be Quitclaimed to Apple Hill, as the area remaining is sufficient for our needs.

RESOLUTION NO.

 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A QUITCLAIM DEED TRANSFERRING ANY INTEREST THE CITY OF BRENTWOOD MAY HAVE IN A PARCEL IDENTIFIED AS A PORTION OF PARCEL B PARK EASEMENT SUBDIVISION NO. 7642 APPLE HILL ESTATES PHASE II FILED MAY 19, 1994 IN BOOK 372 OF MAPS AT PAGE 25, IN THE OFFICE OF THE RECORDER OF CONTRA COSTA COUNTY, CALIFORNIA, TO APPLE HILL ASSOCIATION, A CALIFORNIA NON-PROFIT MUTUAL BENEFIT CORPORATION. 

WHEREAS, Parcel B Park Easement was dedicated on Subdivision Map 7642 Apple Hill Estates Phase II filed May 19, 1994 in Book 372 of Maps at Page 25, in the Office of the Recorder of Contra Costa County, California; and 

WHEREAS, it has been determined that the portion of Parcel B of said map described in the Quitclaim Deed which is adjacent to Apple Hill clubhouse is not required by the City; and 

WHEREAS, a Quitclaim Deed is required to transfer any interest in said portion of Parcel B on said map.

 NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the City Manager to execute a Quitclaim Deed transferring any interest the City of Brentwood may have in a parcel identified as a portion of Parcel B Park Easement Subdivision No. 7642 Apple Hill Estates Phase II filed May 19, 1994 in Book 372 of Maps at Page 25, in the Office of the Recorder of Contra Costa County, California, to Apple Hill Association, a California non-profit mutual benefit corporation. 

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of September 2000 by the following vote:
