RECOMMENDATION
Authorize payment of $31,820.25 to Louis Mangini for compensation of private sprinkler system due to construction of the Sand Creek Road/O’Hara Avenue Extension (CIP Project No. 336-3055) and authorize the City Manager to execute an agreement with Louis Mangini.

PREVIOUS ACTION
On May 11, 1999, by Resolution No. 99-122, the City Council awarded the contract for construction of the Sand Creek Road/O’Hara Avenue Extension to RGW, Inc. On November 8, 1999, the roadway was opened for public use. 

On June 27, 2000, by Resolution No. 2106, the City Council accepted the improvements of Sand Creek Road/O’Hara Avenue Extension from RGW, Inc.

BACKGROUND
In order to construct the Sand Creek Road/O’Hara Avenue Extension, the City had to disrupt the existing irrigation system for the alfalfa fields that Louis Mangini (property owner) was farming for his two parcels, APN 016 120 013 and 014. After discussion with East Contra Costa Irrigation District and the farmer, the City constructed the necessary irrigation improvements for the current crop.

However, at the time of construction, the method for irrigation was gravity flow through earthen ditches. The farmer also had a secondary irrigation system of sprinkler lines that were not being utilized at that time. Mr. Mangini is now switching from a field crop to a row crop, which will require the use of the sprinkler system. The City has agreed to pay for the installation of the new sprinkler lines required in order for the farmer to receive the same level of irrigation service as prior to construction of the road.

The Engineering Department contacted the following three irrigation landscapers: Four Seasons, Ortiz Landscaping, and Delta Excavating to provide an estimate for the new sprinkler system. Delta Excavating provided the sole estimate of $30,305.00.

The Engineering Department is requesting the Council to approve the $30,305.00 plus 5% contract administration services for a total of $31,820.25 to Louis Mangini. The payment will be made once said property owner signs the attached agreement.
