RECOMMENDATION

Authorize the City Engineer to reimburse Spa ‘L’ Builders for $60,704.78 for professional services rendered for the structural design of the underpass at Sand Creek Road, CIP Project No. 336-3061. 

PREVIOUS ACTION

On February 8, 2000, by Resolution No. 2009, Council authorized the City Engineer to submit an application with the Public Utilities Commission of the State of California (PUC) for an order authorizing construction of an at-grade crossing across the Union Pacific Railroad Company tracks at Sand Creek Road, CIP Project No. 336-3061. 

On May 23, 2000, by Resolution No. 2081, Council adopted the Initial Study and Mitigated Negative Declaration for the construction improvements of Sand Creek Road, CIP No. 336-3061.

BACKGROUND

Although the City of Brentwood is actively pursuing an at-grade railroad crossing with Union Pacific Railroad (UPRR) for the future Sand Creek Road; the City originally proposed a roadway underpass for this railroad junction.  At that time, in order to accelerate the design of the bridge for the existing railroad tracks for the roadway underpass, Spa ‘L’ Builders agreed to initially pay for the design of the bridge and to be reimbursed by the City at a later date.  This was agreed upon at the formation of CIFP 98-1. 

However, due to the costly conditions Union Pacific Railroad (UPRR) imposed during the design review process of the structural plans of the bridge for the railroad tracks, the City could not accept the terms.  Immediately afterwards, the City terminated negotiations for a roadway underpass and began requesting an at-grade crossing with PUC and UPRR.  Spa ‘L’ Builders is now requesting reimbursement for their professional services rendered for the structural design of the underpass.
