RECOMMENDATION

Authorize the City Manager to enter into a professional services agreement with Harris and Associates for the design of Brentwood Boulevard Widening (CIP Project No. 336-3054) in the amount of $460,160.63, and authorize the City Manager to approve change orders up to 10% of the contract amount.

PREVIOUS ACTION

On June 27, 2000, Council authorized the City Manager to enter into a professional services agreement with Harris and Associates for the design of Walnut Boulevard Widening (CIP Project No. 336-3056) in the amount of $299,566.89, and authorize the City Manager to approve change orders up to 10% of the contract amounts.

BACKGROUND

Originally the staff report for the June 27, 2000 Council Meeting, requested that the Council also authorize the City Manager to enter into a professional services agreement with Santina and Thompson, Inc. for the design of Brentwood Boulevard Widening (CIP Project No. 336-3054) in the amount of $473,721.37.  However prior to the meeting, the Engineering Department requested in a memo that the Council only authorize the agreement with Harris and Associates for the design of Walnut Boulevard Widening (CIP Project No. 336-3056).

On June 27, 2000, the Engineering Department terminated all negotiations with Santina and Thompson, Inc. and commenced negotiations with Harris and Associates for the design of Brentwood Boulevard.  The cost proposal was prepared by Harris and Associates and accepted by the Engineering Department.  Staff was prepared to bring this design agreement to the July 11, 2000 Council Meeting.

However, Santina and Thompson, Inc. filed a written protest and requested that the City not authorize the agreement with Harris and Associates at the July 11, 2000 Council Meeting.  The City complied with the request and removed said action from the Council Agenda.  Subsequently, the City has reviewed the protest and has determined there is no substance to the claim.  The City Attorney has recommended that the Engineering Department move forward with the request for the Council to authorize the agreement with Harris and Associates for the design of Brentwood Boulevard Widening (CIP Project No. 336-3054) in the amount of $460,160.63.

The City is required to fund the difference between actual construction costs (expected to be approximately two million dollars, and the federal grant of $1,330,000 dollars.  The City is also responsible for approximately 11.47% of the 1.33 million as a local match.  This design contract will be funded by the City (facility fees).  This contract is also written to comply with federal grant funding protocol, however, based on the estimated construction costs, this design project will not likely qualify for federal funding and the City will utilize all federal funding during construction.
