Adopt a resolution approving reimbursement to Pulte Home Corporation and William Lyon Homes from the Parks and Trails Facility Fee Fund for construction of a bicycle/pedestrian asphalt trail along the eastern boundary of Subdivisions 8196, 8197 and 8178 in Spa 'L.'
On November 24, 1998, City Council adopted Resolution Nos. 98-203 and 98-204 approving reimbursement agreements with Pulte Home Corporation and William Lyon Homes for Master Plan Facility Improvements.
On February 8, 2000, City Council adopted Resolution 2011, which added this section of trail to the 1999/2004 Capital Improvement Program and incorporated it into the Master Plan.
The Conditions of Approval for Tentative Map 8033 required that this section of trail be constructed if it were incorporated into the Master Plan by the time of the first final map filing. This resolution will approve reimbursement from the Parks and Trails Facility Fee Fund to Pulte Home Corporation and William Lyon Homes for the construction of approximately 2,659 LF of 10' wide with 2' shoulders, bicycle/pedestrian trail. Both developers paid full parks and trail fees. The amount of reimbursement for this section of trail will be $74,013.19 for Pulte Home Corporation and $52,565.63 for William Lyon Homes, for a total of $126,578.82. Hydro seeding along Pulte's section of trail will occur in October 2000, at which time an additional amount of $9,256.87 will be reimbursed. The City will do the hydro seeding along William Lyon's section of trail with the Sand Creek Road CIP Project (336-3061).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING REIMBURSEMENT TO PULTE HOME CORPORATION AND WILLIAM LYON HOMES FROM THE PARKS AND TRAILS FACILITY FEE FUND FOR THE CONSTRUCTION OF A BICYCLE/PEDESTRIAN TRAIL ALONG THE EASTERN BOUNDARY OF SUBDIVISIONS 8196, 8197 AND 8178 IN SPA 'L.
WHEREAS, on June 3, 1997, by Resolution No. 97-21, the Planning Commission of the City of Brentwood approved the Tentative Map of Subdivision 8033, with conditions; and
WHEREAS, on February 8, 2000, by Resolution No. 2011, the City Council of the City of Brentwood incorporated this trail into the Master Plan; and
WHEREAS, certain Master Plan Facility improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and
WHEREAS, the Developers will construct the improvements eligible for reimbursement.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve reimbursement to Pulte Home Corporation and William Lyon Homes for the construction of a bicycle/pedestrian trail along their eastern boundary in Spa 'L' as outlined in the Trail Reimbursement Calculation Sheet.
