Adopt a resolution approving a Reimbursement Agreement with the Hofmann Land Development Company for costs associated with Master Plan Facility Improvements.
On April 12, 1994, the City Council adopted Resolution No. 94-63, which established a standard reimbursement agreement for Master Plan Facility Improvements.
On November 17, 1998, the Planning Commission of the City of Brentwood adopted PC Resolution No. 98-58, which approved Tentative Map 8055. Conditions of Approval for this map required that the Developer construct certain Master Plan Facility Improvements. Master Plan Facility Improvements are those improvements that have been identified in the Master Infrastructure element of the General Plan. The Subdivision Map Act requires that the City enter into a Reimbursement Agreement when requiring a developer to construct improvements with capacity in excess of the needs of their development alone. The reimbursement calculations are based on the City of Brentwood 1999 Development Fee Program. This agreement covers both subdivisions included under Tentative Map 8055. The items that qualify for reimbursement are pre-payment of fees for roadway facilities and pre-payment of fees for wastewater treatment plant expansion. The improvements that qualify for excess capacity are oversize improvements along Minnesota Avenue and the developer's share of oversize water main improvements and oversize sewer main improvements. All facility fee funds will have a positive cash flow.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A REIMBURSEMENT AGREEMENT WITH THE HOFMANN LAND DEVELOPMENT COMPANY FOR SPA 'L' SUBDIVISIONS 8055 AND 8176 FOR COSTS ASSOCIATED WITH MASTER PLAN FACILITY IMPROVEMENTS.
WHEREAS, in November 1998 the Planning Commission of the City of Brentwood adopted PC Resolution No. 98-58 which required the Developers of Tentative Subdivision 8055 to make certain Master Plan Facility Improvements; and
WHEREAS, certain Master Plan Facility improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and
WHEREAS, the developer has constructed the improvements eligible for reimbursement.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve a Reimbursement Agreement with the Hofmann Land Development Company for Master Plan Improvements constructed in conjunction with Subdivisions 8055 and 8176, covered under Tentative Subdivision Map No. 8055, as shown on attached Exhibit "A".
