Subdivision 8221, Signature Properties, Final Map Acceptance

of a Resolution approving the Final Map of Subdivision 8221, Signature
Properties located south of Chestnut Street and west of Garin Parkway,
accepting the improvement security, approving the Subdivision Improvement
Agreement, approving transfer of said property described in document number
98-0246247 by quitclaim deed to Signature Properties, and authorizing
the Mayor and City Clerk to execute the same.
August 3, 1999, by Resolution No. 99-31, City Council approved Tentative
Subdivision Map 8221, with conditions.
Final Map is located south
of Chestnut Street and west of Garin Parkway.
This Final Map has been checked for conformance with the approved Tentative
Map and Conditions of Approval.
The developer has executed a Subdivision Improvement Agreement,
the appropriate improvement security (Faithful Performance and Labor &
Materials Bonds 3SM98348200, each for the amount of $2,253,050.00) has
been posted, and offers of dedication for the appropriate roadways and
easements have been made.
In order for the Final Map to be recorded, the Council needs to approve both the Final Map and the Subdivision Improvement Agreement, accept the offers of dedication as shown on the map subject to acceptance of the improvements, accept the improvement security, and authorize the Mayor and City Clerk to execute the Subdivision Improvement Agreement.
developer is responsible for necessary repairs to subdivision improvements
for a period of 12 months following acceptance of the improvements for
maintenance. The City will
then incur costs, the amount of which is unknown at this time, associated
with street sweeping and necessary repairs to streets and/or utilities.
A Lighting and Landscape Maintenance District has been formed for
this subdivision and will be responsible for the street lighting and landscape
well site No. 13, located within subdivision 8221, which is more particularly
described in document number 98-0246247, was deeded to the City from Signature
Properties in 1998. Well
No. 13 has now been reconfigured, and therefore the City must deed the
original area back to Signature Homes in exchange for the correct well
site configuration. The reconfigured
site is dedicated on this Final Map as Parcel ‘B.’
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE
FINAL MAP OF SUBDIVISION 8221, SIGNATURE PROPERTIES, LOCATED
SOUTH OF CHESTNUT STREET AND WEST OF GARIN PARKWAY,
ACCEPTING THE OFFERS OF DEDICATION SHOWN THEREON SUBJECT TO ACCEPTANCE
OF IMPROVEMENTS, ACCEPTING THE IMPROVEMENT SECURITY, APPROVING THE SUBDIVISION
IMPROVEMENT AGREEMENT, APPROVING TRANSFER OF SAID PROPERTY DESCRIBED IN
DOCUMENT NUMBER 98-0246247 BY QUITCLAIM DEED TO SIGNATURE PROPERTIES AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE SAME
on August 3, 1999, by Resolution No. 99-31, the City Council of the City
of Brentwood approved the Tentative Map of Subdivision 8221, with conditions;
Final Map 8221 showing 100 lots has been prepared for this subdivision;
City staff has checked the Final Map for conformance with the approved
Tentative Map and the Conditions of Approval dated August 3, 1999, and
finds that the Final Map is ready for approval.
City well site no. 13, located within Subdivision 8221, which is more
particularly described in document number 98-0246247, was deeded to the
City of Brentwood from Signature Properties in 1998, and now has been
reconfigured within the subdivision; and
NOW, THEREFORE BE IT RESOLVED
that the City Council of the City of Brentwood does hereby approve the
transfer of said property described in document number 98-0246247 by Deed
from the City of Brentwood to Signature Properties and further approves
the Final Map for Subdivision 8221, and that the offers of dedication
shown thereon are hereby accepted subject to acceptance of improvements,
except Parcel ‘A’ and ‘B’ which are accepted in Fee with the acceptance
of this map.
IT FURTHER RESOLVED that the Subdivision Improvement Agreement is
hereby approved, that the improvement security accompanying said agreement
is hereby accepted, and that the Mayor and City Clerk are hereby authorized
to execute said Subdivision Improvement Agreement.
IT FURTHER RESOLVED that the City Manager and the City Right of Way
Agent are authorized to execute and deliver a quitclaim deed conveying
the real property described in document number 98-0246247 to Signature
PASSED, APPROVED AND ADOPTED
by the City Council of the City of Brentwood at a regular meeting on the
27th day of June 2000 by the following vote:
